KAJALA ALIA SEGEREA SIYO SEHEMU YA MATANUZI

Happiness Katabazi MSANII wa filamu nchini, Kajala Masanja, jana alimwaga machozi na kuujia juu upande wa jamhuri katika kesi inayomkabili ya utakatishaji fedha haramu katika Mahakama ya Hakimu Mkazi Kisutu Dar es Salaam, akiushinikiza ulete mashahidi haraka kwani mahabusu anakoishi siyo sehemu ya starehe. Kajala alitoa shinikizo hilo mbele ya Hakimu Mkazi, Sundi Fimbo, muda mfupi baada ya wakili wa Taasisi ya Kuzuia na Kupamba na Rsuhwa (TAKUKURU), Leonard Swai, kuikumbukusha mahakama kuwa kesi hiyo ilikuja jana kwa ajili ya upande wa jamhuri kuanza kutoa ushahidi wao, lakini akadai hilo halitaweza kufanyika, kwa sababu hajaja na mashahidi na anaomba kesi hiyo iahirishwe. Baada ya wakili huyo kumaliza kutoa maelezo hayo, ndipo Kajala akanyosha kidole na kuomba ruhusa ya mahakama ili aweze kuzungumza jambo. “Mheshimiwa hakimu, hivi huyu wakili wa serikali anafikiri kule Segerea ninakoishi kwa sasa ni sehemu ya starehe? Mahabusu kunatisha, wewe wakili wa serikali lete mashahidi kesi isikilizwe,” alidai Kajala huku akitokwa na machozi. Kwa upande wake, Hakimu Fimbo aliahirisha kesi hiyo hadi Mei 9 ambapo upande wa jamhuri unatakiwa ulete mashahidi wake ili waanze kutoa ushihidi. Machi 27, mwaka huu, ilidaiwa na wakili Swai kuwa mbali na Kajala, mshtakiwa mwingine ni mumewe, Faraja Chambo, wanakabiliwa na makosa matatu, kosa la kwanza ni la kula njama kinyume na kifungu cha 34 cha Sheria ya Kuzuia na Kupambana na Rushwa ya mwaka 2007, ambapo washtakiwa wote kwa pamoja walitenda kosa hilo la kula njama la kuhamisha umiliki wa nyumba iliyoko Kunduchi Salasala, eneo ambalo halijapimwa jijini Dar es Salaam. Shtaka la pili ni kwamba Aprili 14 mwaka 2010, walihamisha isivyo halali umiliki wa nyumba hiyo, ambayo walikuwa wakiimiliki kwenda kwa Emilian Rugalia, ambaye ndiye waliyemuuzia kinyume na kifungu cha 34(2)A(3) cha Sheria ya TAKUKURU ya mwaka 2007. Na shtaka la tatu ni la kutakatisha fedha, ambalo walilitenda siku hiyo ya Aprili 14, 2010 huku wakijiua ni kinyume cha sheria hiyo. Chambo naye yuko mahabusu kwa zaidi ya mwaka mmoja sasa, kwa sababu anakabiliwa na kesi nyingine ya utakatishaji fedha haramu, iliyofunguliwa mahakamani hapo, ambapo kwa mujibu wa sheria, kosa hilo halina dhamana. WAKANDARASI WAZALENDO SASA MSHINDWE WENYEWE

Na Happpiness Katabazi IJUMAA ya wiki hii, Naibu Katibu Mkuu wa Wizara ya Ujenzi John Ndunguru kwaniaba ya serikali alitia saini mkataba wa ujenzi wa daraja la Mto Mbutu lilopo wilani Igunga mkoani Tabora na makampuni 13 ya wakandarasi wazalendo watakao jenga daraja hilo ambapo ujenzi wa daraja hilo utagharimu jumla ya Sh bilioni 12. 34 ambao unatarajiwa ukamilike Septemba mwakani. Mkataba huo ulisainiwa katika sherehe za utiwai saini zilizofanyika siku hiyo katika ofisi za wakara wa Barabara Tanroads,Morocco Jijini Dar es Salaam, na kuudhuliwa na watendaji wa wizara hiyo na waandishi wa habari ambapo mimi ni miongoni mwa waandishi wa habari tulioalikwa kushiriki kushuhudia tukio hilo ambalo limeandika historia mpya mpya hapa nchini. Kwani wakandarasi wazalendo kwa muda mrefu wamekuwa wakilailalamikia serikali kwa kushindwa kuwajengea uwezo kwa kuwapatia zabuni za ukandarasi na matokeo yake serikali imekuwa ikitoa kwa wingi tenda za ukandarasi kwa makampuni ya nje hususani kampuni toka nchini China wakati kuna watanzania wazalendo wanaweza kufanya shughuli hizo za kikandarasi. Akizungumza katika sherehe za utiaji saini wa mkabata baina ya serikali na makampuni hayo 13 Ndunguru alisema hatua hiyo ni ya kihistoria na pia ni utekelezwaji wa ahadi iliyowahi kutolewa na serikali ya awamu ya nne inayoongozwa na Rais Jakaya Kikwete kuwa itawajengea uwezo makandarasi wazalendo kwa kuwapatia tenda za ukandarasi. Na kwamba serikali imeamua kuwapatia kazi hiyo na kuwa kazi hiyo waliyopewa ni changamoto kwao kwani kuna makampuni mengi ya kigeni yamekosa fursa hiyo badala yake serikali imetoa fursa hiyo kwa makampuni hayo Akizungumza kabla ya kutiliana sanii kwa mkataba huo, Mkurugenzi wa Wakala wa Barabara Tanzania, (TANROADS), Patrick Mfugale alisema makampuni hayo ya wakandarasi 13 wameungana katika mradi huo wa ujenzi wa daraja katika bonde la mto mbutu lenye upana wa kilomita 3. “Daraja hilo litajengwa kwa zege na saruji, litakuwa na urefu wa mita 40 na upana wa mita 10.7, litakuwa na uwezo wa kubeba gari lenye uzito wa juu unaokubalika kisheria hapa nchini ambao ni tani 56,”alisema. Mfugale alisema daraja la mbutu pia litahusisha ujenzi wa makaravati saba ya zege yenye upana wa mita 8 hadi 14 ambayo yatajumuisha ujenzi wa tuta la barabara lenye urefu wa kilomita tatu kwa kiwango cha changarawe. “Jumla ya kampuni 13 yakiwemo Skol Building Contractors Ltd, Del Montel (T) Ltd, Mayanga contractors Company Ltd,CASCO Construction Ltd, Electrics International Company Ltd, KIKA construction Company Ltd, GEMEN engineering Company Ltd, Milembe Construction Company Ltd, Lukolo Company ltd ,MAC Contractors Co.Ltd,Nyakirang’anyi Construction Ltd, Nyegezi J.J construction Ltd na Concrete Maters company (T) Ltd ,”alisema Mfugale. Vile vile imeelezwa mawasiliano yataimarishwa kati ya wananchi wa Wilaya ya Kishapu mkoani Shinyanga na Meatu iliyopo Shimiwi na wilaya ya Igunga wakati wote. Kwani ujenzi wa daraja hilo umetokana na mvua kubwa iliyonyesha kipindi cha nyuma ambayo ilisababisha uhalifu mkubwa wa daraja hilo hali iliyosabisha wananchi. Naye mwakilishi wa makampuni hayo 13 akizungumza kwaniaba ya makandarasi hao Injinia Stephen Makigo alisema wanaishukuru Serikali kuwakumbuka na hatua hiyo itasaidia kukuza uchumi kwani fedha hizo zitazunguka ndani. Kwa kiai Aidha aliakikishia serikali kuwa watafanyakazi kwa ushirikiano na umahiri wa hali ya juu kwani wakijenga daraja hilo chini ya kiwango siku nyingine serikali itashindwa kuwaamini na kuwapatia kazi nyinge za kikandarasi. Alisema inatarajiwa wakandarasi wazalendo watakapokamilisha ujenzi wa mradi huu watakuwa na uwezo wa kujenga miradi mingine inayofanana na huu na hivyo kupunguza serikali kuwa tegemezi kwa wakandarasi wa nje kwa kazi za ujenzi wa barabara. Aidha alisema fedha zinazolipwa kwa miradi inayotekelezwa na wakandarasi wazalendo kwa kiasi kikubwa itabaki na kuzungushwa nchini hivyo kukuza uchumi wa wa Tanzania na pia miradi itakayotekelezwa na wananchi itaongeza ajira kwa wananchi na kusaidia kuinua vipato vyao. Binafsi napongeza hatua hiyo ya serikali ya kuwakumbuka wakandarasi wetu wa ndani na kuwapatia mradi mkubwa kama huu ili waweze kuanza ujenzi.Lakini pia nayapongeza makampuni hayo 13 kwa uamuzi wao mzuri wa kujiunga pamoja na kukubaliana kufanyakazi kwa pamoja kwaajili ya kulijenga daraja hilo ili wananchi wenzetu wa Igunga nao waweze kuwa mawasiliano ya uhakika ya barabara kutoka eneo moja hadi nyingine katika vipindi vyote vya mwaka kati ya vijiji vilivyopo katika tarafa ya Igurubi yenye wakazi zaidi ya 94,449 na mji wa Igunga. Hakuna ubishi kwa hatua hiyo ya serikali kuwapatia kazi hiyo makandarasi wa ndani kwa kiasi fulani utasaidia fedha za serikali zitakazowalipa makampuni hiyo,zitalipwa kwa kiwango cha fedha za Tanzania na siyo kegeni hivyo ni dhahiri serikali itajikuta inatumia angalau kiasi kidogo cha gharama ukilinganisha na kama zabuni hiyo ingekuwa imepewa makampuni ya nje,serikali ingelazimika kuwalipa wakandarasi hao wan je kwa kutumia fedha za kigeni wakati kila kukicha fedha yetu inazidi kumezwa na dola ya kimarekani. Napenda kuyaasa makampuni hayoi 13 yalibahatika kupewa kazi hiyo na serikali, yaende kufanya kazi waliyoomba na kwa makubaliano waliyokubaliana na serikali katika mkataba waliouingia baina yao, kwani endapo makampuni hayo yataenda kufanyakazi chini ya viwango,ni wazi kabisa watakuwa wamesababisha yale makampuni mengine ya ukandarasi wazalendo ambayo hayakuoata fursa ya kuchaguliwa kujenga daraja hilo ,nao hawataaminiwa tena serikali yetu kupewa tenda za ujenzi kwani kuna msemo mmoja usemao ‘samaki mmoja akioza wote wameoza’. Na tunamuomba Waziri wa Ujenzi, John Magufuli na timu yake ukali ule ule anaowanyesha makandarasi wageni ambao ni wazembe, tunataka auonyeshe kwa makandarasi wazalendo hasa katika mradi wa ujenzi wa daraja la Mbutu,pindi atakapobaini wakandarasi hao wanazembea bila ya kuwaonea haya. Ninaimani hapa nchini kuna wakandarasi wengi wamesoma vizuri na ndiyo maana hata hayo makampuni ya kigeni yanayopewa tenda na serikali yetu kujenga mabarabara mwisho wa siku makampuni hayo ya kigeni yanaamua kuwatumia wakandarasi wa Kitanzania kuwasadia kujenga ujenzi. Lakini nimalizie kwa kuiasa serikali yetu nayo itoe fedha kwa wakati kwa wakandarasi ambao wameishaingia nao mkataba wa kufanya shughuli za kikandarasi kwani kuna manung’uniko ya chini chini ya muda mrefu ambayo baadhi ya wakandari hata wa miradi midogo ya ujenzi wamekuwa wakiilamikia serikali kwa kushindwa kuwapatia kwa wakati fedha wakandarasi ili wawendelee na ujenzi na matokeo yake wakandarasi hao wamekuwa wakijikuta ama wakijenga chini ya kiwango idi mradi akamilishe ujenzi ndani ya muda wa mkataba waliokubaliana. KESI YA SIMON JENGO YADODA

Na Happiness Katabazi MAHAKAMA ya Hakimu Mkazi Kisutu Dar es Salaama,jana ililazimika kuiarisha kesi hiyo ambayo ilikuja kwaajili ya upande wa Jamhuri kumsomea maelezo ya awali aliyekuwa Naibu Mkurugenzi wa Mifumo na Uendeshaji ya Benki Kuu ya Tanzania (BoT), Simon Jengo,kwasababu mawakili wa Taasisi ya Kuzia na Kupambana na Rushwa kuwa na udhuru. Wakili wa Serikali Leonard Chalo mbele ya Hakimu Mkazi Rita Tarimo alieleza kuwa kesi hiyo ilikuja jana kwaajili ya upande wa Jamhuri kumsomea maelezo ya awali lakini hilo haliwezi kufanyika kwasababu mawakili wa Takukuru wanaudhuru hivyo wakaomba kesi hiyo iairishwe. Januari 30 mwaka huu, Wakili kiongozi wa serikali, Fredrick Manyanda, aliyekuwa akisaidiwa na Ben Lincoln na Shardrack Kimaro, mbele ya Hakimu Mkazi, Ritha Tarimo, alidai kuwa kati ya Juni 2005 na Desemba 2008 akiwa mtumishi wa benki hiyo, alimshauri Gavana vibaya ili benki hiyo inunue mitambo 26 ya kuharibu noti pasipo kujali hali ya BoT. Hii ni mara ya pili kwa Jengo kushtakiwa. Kesi ya kwanza inamkabili Jengo na wenzake ambayo inaendelea kusikilizwa katika Mahakama ya Wilaya ya Ilala na wanakabiliwa na makosa ya kuisababishia hasara benki hiyo. Wakili wa Serikali Elizabeth Kaganda mbele ya Hakimu Binge Mashabara aliikumbusha mahakama kuwa kesi jana ilikuja kwaajili kuwasomea washtakiwa hao maelezo ya awali na kwamba wao upande wa jamhuri wapo tayari kwaajili ya kuwasomea maelezo hayo ya awali. Lakini Hakimu Mashabara alisema upande wa jamhuri hautaweza kuwasomea maelezo ya awali washtakiwa hao kwasababu hakimu Lema ambaye ndiye anayesikiliza kesi hiyo tangu ilipofunguliwa yupo nje ya ofisi amekendwa kuudhuria semina na hivyo anaiarisha kesi hiyo hadi Mei 15 mwaka huu. Mbali na Kibanda washtakiwa wengine ni mwandishi wa makala hiyo Samson Mwigamba na Kaimu Mhariri Mtendaji wa Kampuni ya Mwananchi Communication Ltd, Theophil Makunga ambao wanatetewa na mawakili wa kujitegemea Mabere Marando, Juvenalis Ngowi, Isaya Matamba, John Mhozya na Frank Mwilongo. Machi 7 mwaka huu, Wakili Kaganda akiisoma hati mpya ambayo ina mashtaka mawili tu ambapo kosa la kwanza ni la uchochezi kinyume na kifungu cha 32(1)(c) na 31(1)(a) cha Sheria ya Magazeti Sura ya 229 ya mwaka 2002 ambalo lina mkabili mshtakiwa wa kwanza na wa pili yaani Mwigamba na Kibanda. Shtaka la pili ambalo linamkabili Makunga peke yake ni la kuchapisha waraka wa uchochezi kinyume na kifungu cha 32(1) ( c) na 31 (1)(a) vya Sheria ya Magazeti Na.229 kama ilivyofanyiwa marekebisho mwaka 2002 kwamba Novemba 30 mwaka 2011, Makunga akiwa na wadhifa huo alichapisha makala ya uchochezi iliyokuwa na kichwa cha habari kisemacho ‘ Waraka Maalum kwa askari wote’ ambayo iliandikwa na gazeti la Tanzania Daima Toleo Na. 2552 la Novemba 30 mwaka 2011, iliyokuwa na kichwa cha habari kisemacho “ Waraka Maalum kwa askari wote’ ambapo ilikuwa ikiwachochea askari wa Jeshi la Ulinzi la Wananchi (JWTZ), Jeshi la Magereza na Polisi wasitii mamlaka za Serikali ya Jamhuri ya Muungano wa Tanzania. WAZIRI WA ZAMANI KORTINI KWA UDANGANYIFU

Na Happiness Katabazi ALIYEKUWA Waziri mwandamizi wa Serikali ya Jamhuri ya Muungano wa Tanzania kwa awamu tofauti Arcado Ntagazwa(65) amefikishwa katika Mahakama ya Hakimu Mkazi Kisutu Dar es Salaam, kwa kosa moja tu la kujipatia kofia,fulana zenye jumla ya thamani ya shilingi milioni 74.9 kwa njia ya udanganyifu. Mbali na Ntagazwa washtakiwa wengine ni Senetor Mirelya (60) na Webhale Ntagazwa ambao wanatetewa na wakili wa kujitegemea Alex Mgongolwa. Wakili wa Serikali Ladslaus Komanya mbele ya Hakimu Mkazi Liad Shamshama alidai kuwa Oktoba 22 mwaka 2009 huko Msasani Mikoroshini washtakiwa hao kwania ovu walijipatia fulana 5000 na kofia 5000 zenye jumla ya thamani ya Shilingi milioni 74.9 toka kwa Noel Sevele kwa makubaliano kuwa wangemlipa Sevele kiasi hicho cha fedha katika kipindi cha mwezi mmoja tangu walipochukua vifaa hivyo lakini hata hivyo walishindwa kumlipa na washtakiwa walikana shtaka na kwamba upelelezi wa kesi hiyo bado haujakamilika. Washtakiwa hao walikana shtaka hilo na Hakimu Mshamsha alisema kosa linalowakabili washtakiwa lina dhamana na kwamba atatoa dhamana kwa kufuata matakwa ya kifungu cha 145(5)(e) cha Sheria ya Mwenendo wa Makosa ya Jinai ya mwaka 2002, ambapo kifungu hicho kinamtaka kila mshtakiwa atoe nusu ya kiasi cha fedha au kuwasilisha hati ya mali isiyoamishika yenye nusu ya thamani ya kiasi cha fedha anachotuhumiwa nacho. Hakimu Shamshama alisema kwa kuwa katika kesi hiyo washtakiwa wapo watatu kwa hiyo kiasi cha sh milioni 74.9 kitagawanywa nusu yake na hivyo kila mshtakiwa atatatiwa awasilishe fedha tasilimu au kuwasilisha hati ya mali isiyoamishika yenye thamani ya Sh milioni 12 na wadhamini wawili ambao wanavitambulisho vinavyotambulika na kwamba watasaini bondi ya Sh milioni tano kila mmoja na kwamba hawataruhusiwa kutoka nje ya mkoa bila ruhusa ya mahakama. Hata hivyo ni Arcado Ntagazwa na Webhale Ntagazwa ndiyo waliopata dhamana baada ya kutimiza masharti ya dhamana na mshtakiwa wa kwanza Mirelya alishindwa kutimiza mashatri ya dhamana na hivyo akapelekwa gerezani na kesi hiyo ikaairishwa hadi Mei 2 mwaka huu, itakapokuja kwaajili ya kutajwa. Ntagazwa ambaye kwa sasa ni mwanachama wa Chama cha Demokrasia na Maendeleo(Chadema), kabla ya kujiunga na chama hicho miaka minne iliyopita, akitokea chama cha Mapinduzi (CCM).Akiwa mwanachama wa CCM, aliwahi kuteuliwa na rais wa Serikali ya awamu ya pili na ya tatu, Ally Hassan Mwinyi na Benjamin Mkapa kushika nyadhifa za uwaziri katika wizara mbalimbali hadi ilipofika mwanzoni mwa mwaka 2006, Rais Jakaya Kikwete alipounda baraza lake jipya la mawaziri na kuamuacha nje ya baraza hilo. Ntagazwa ambaye aliwahi kuwa mbunge wa muda mrefu wa Jimbo la Mhambwe kwa tiketi ya CCM, hadi sasa nakumbukwa kwa msemo wake mmoja maarufu aliowahi kuutoa bungeni akiwa Waziri Nchi ofisi ya Makamu wa Rais anayeshughulikia Mazingira alisema ‘Ipo siku wajukuu zetu watafukua makaburi yetu wachunguze ubongo wetu kama tulikuwa na akili timamu’. Ntagazwa alitoa msemo huo kutokana na kutoridhishwa na baadhi ya maamuzi yaliyokuwa yakifanywa na baadhi ya watendaji waliopewa dhamana. Wakati huo huo; Raia wa Mali , Albeto Mardes jana alifikishwa mahakamani hapo mbele ya Hakimu Mkazi Devota Kisoka kwa kosa kuingiza dawa za kulevya Tanzania zenye uzito wa gramu 12777 ambazo zina thamani ya Shilingi milioni 57.8 aina ya Heroin. Wakili wa Serikali Ester Kyala alidai kuwa mshtakiwa huyo ambaye anaishi Guine Bisau Aprili 15 mwaka huu, alikamatwa katika Uwanja wa Ndege wa Mwalimu Julias Nyerere akiwa na dawa hizo za kulevya ambazo ni kinyume na kifungu 16(1) b (1) cha Sheria ya Kuzuia uingizwaji wa Dawa za Kulevya ya mwaka 2002 na kwamba upelelezi wa kesi hiyo bado haujakamilika. Hakimu Kisoka alisema kwa kuwa kosa hilo halina dhamana kwa mujibu wa sheria na kwamba mahakama yake haina mamlaka ya kusikiliza kesi hiyo na kwamba mahakama Kuu ndiyo yenye mamlaka ya kusikiliza kesi hiyo, mshtakiwa huyo hatatakiwa kusema chochote na hivyo akaamuru apelekwe gerezani hadi hadi Mei 7 mwaka huu, itakapokuja kwaajili ya kutajwa. NAENDELEA KUMLILIA DITOPILE MZUZURI-2012

NAMLILIA DITOPILE Na Happiness Katabazi ILIKUWA juzi saa 4:39, asubuhi, nikiwa nimeketi sebuleni na kunywa chai nyumbani kwetu Sinza ‘C’, nilipokea simu kutoka kwa mfanyakazi mwenzangu ambaye ni mchora katuni aitwaye, Said Michael ‘Wakudata’ akiniambia rafiki yako, Brother Ditopile, amefariki dunia. Nilishtuka na ghafla mapigo ya moyo yalianza kwenda mbio huku mikono ikitetemeka na kusababisha simu yangu ya kiganjani kuanguka kwenye zulia. Kwakuwa hapo sebuleni nilikuwa nimekaa na mama yangu mzazi na kaka zangu, mama yangu alishtuka, akanikaribia na kuniuliza kulikoni? Ndipo nilipomweleza kwamba nimepokea simu inayosema rafiki yangu Ukiwaona Ditopile Mzuzuri (60) amefariki dunia. Kwakuwa mama yangu naye alikuwa akimfahamu Ditopile, alishikwa butwaa. Kwakuwa siku hizi taarifa za kuzushiana vifo zimekuwa za kawaida ndani ya taifa hili, sikutaka kuziamini moja kwa moja taarifa hizo, niliamua kuokota chini ile simu yangu na kuanza kupiga kupitia namba zake (Ditopile) zote nne, ambazo nilizitumia kuwasiliana naye mara kwa mara. Nilipokuwa napiga simu kwenye line zote hizo, line zote zilikuwa hazipatikani. Ndipo nilipochukua uamuzi wa kumpigia simu aliyekuwa Katibu Mkuu wa timu ya Ashanti, Arafat Said, kwa kuwa marehemu alikuwa ni mlezi wa timu hiyo, kumuuliza kuhusu tukio hilo, naye alinithibitishia ni kweli. Nikabaki nimejiinamia kwa simanzi kutwa nzima na kuishia kumwombea kwa Mungu. Mara ya mwisho kuwasiliana na Ditopile ilikuwa ni Ijumaa saa mbili usiku ya wiki iliyopita. Alinipigia akaanza kwa kunitania kwamba muda si mrefu nitakuwa mkwe wake kwa mtoto wake wa kiume aitwaye Ramadhani, ambaye yupo masomoni Uingereza. Nikamjibu kwa kumtania kwamba sitakuwa tayari kuwa na baba mkwe ambaye ni chakaramu kama yeye, akajibu kwamba hiyo ndiyo tabia yake tangu mdogo, hivyo hawezi kuibadili ukubwani na kwamba yeye ataongoza msafara wa wazee wa Pwani kwenda kwa mzee Katabazi kumchumbia paparazzi (yaani mimi), ili familia yake iwe na mwandishi wa habari, kwani waandishi wa habari ambao enzi za uhai wake alipenda kuwaita paparazzi, walimuandika sana kwa mabaya yake na mazuri yake. Baada ya kunieleza hayo, nilimweleza kwamba kuna mtoto wako aitwaye Ramadhani Mzuzuri, mapema wiki iliyopita alitembelea blog yangu na kuniachia ujumbe wa kupongeza kazi zangu, nami nilimuliza Ramadhani kwakutumia e- mail kwamba Ditopile ni baba yake na kama ni baba yake basi mimi rafiki yake. Nilivyomweleza hivyo Ditopile, akaniambia hiyo ni sababu moja wapo iliyosababisha anipigie simu siku hiyo na akanieleza kweli yule ni mtoto wake.Baada ya kumaliza hadithi hiyo akaniomba nimsaidie kufahamu kesi yake imepangwa lini na kwa jaji yupi. Nilimwambia kuwa nipe sekunde chache nitoe kitabu changu cha kumbukumbu ili niweze kukutajia tarehe, nikamweleza kwamba kesi yake itatajwa kwa mara ya kwanza Aprili 24 mwaka huu, mbele ya Jaji Njegafibili Mwaikugile. Alishukuru na kuniambia: “Eh siku hiyo mapaparazzi wenzio wamejiandaaje kuja kunipiga picha?” Nilimjibu huku tupo timamu na kwamba siku hiyo tutahakikisha tunazingira pembe zote za Mahakama Kuu bila yeye kujua ili kuhakikisha tunaipata sura yake.Akacheka sana, akasema mapaparazzi mna taabu kweli. Namlilia rafiki yangu Ditopile kwani tangu atoke jela nimekuwa nikiwasiliana naye mara kwa mara kwa simu. Ila mara ya mwisho kuonana naye ana kwa ana na kuzungumza naye kwa takriban saa mbili ilikuwa ni Desemba 9, 2006 ndani ya Gereza la Keko alipokuwa amewekwa rumande. Kama inavyofahamika, waandishi wa habari huwa hawaruhusiwi kuingia magerezani, lakini mzee Ditopile alimtuma mtu anipigie simu niende kumuona gerezani, ila nikifika pale gerezani nijitambulishe kwa jina bandia la Koku Katabazi, nimetokea mkoani Kagera na kwamba nivalie mavazi ya gauni kubwa na kitambaa kichwani ili maofisa magereza wa gereza hilo wasinitambue. Kweli nilifanya hivyo na kabla ya kufikia sehemu ya kujiandikisha kwenye daftari la wageni, nilinunua maji chupa makubwa na mkate na tayari kusubiri niitwe jina la kuingia kumuona Ditopile. Nilivyoitwa jina hilo, nilishtukia nadakwa kiaina na ndugu na jamaa wa mzee Ditopile na wakanieleza nisiwe na wasiwasi watanipeleka gerezani anapolazwa. Kweli ilipofika zamu yangu, niliingizwa ndani ya gereza huku nikiambatana na ndugu yake mmoja ambaye ni mtu mzima kiumri, nikapandishwa sehemu ya kuzungumzia wageni ambapo ni hatua tano kutoka chumba alichokuwa akilala yeye na wenzake maarufu kwa jina la ‘Sick Bay’. Baada ya kufika na kuketi kwenye kiti, Ditopile alitoka chumbani akaja kuzungumza nami, nilishindwa kujizuia nilibubujikwa machozi. Akaniita jina langu akisema na ujanja wako wote unalia? Nilimjibu kuwa jela si kuzuri, hasa anapopelekwa mtu unayemfahamu. Akanijibu kwamba yote ni mipango ya Mungu na tumuachie Mungu. Nilianza kumuuliza maswali ya hapa na pale kwamba ni kweli alikuwa amemuua yule dereva wa daladala, Hassan Mbonde (33), alisema ni kweli Novemba 4 mwaka 2006, alimuua kwa kumpiga risasi, ila hakuwa amekusudia kufanya tukio hilo, kwani dereva wa daladala aliligonga gari lake na alipowaambia kwanini waliligonga, dereva huyo alimtukana kwa kumuonyesha ishara ya kidole cha katikati. “Happiness, kwakweli kwa utu uzima niliokuwa nao, wadhifa niliokuwa nao kweli mtu dereva alinigonga na nilipomhoji alinitusi kwa kutumia kidole cha katikati ya mkono wa kulia…kwakweli niligadhabika sana nikajikuta nachomoa silaha na kumfyatulia, licha ya kwamba halikuwa lengo langu. “Siwezi kukana kwamba sikumuua yule dereva, ila nilimfyatulia risasi kutokana na hayo aliyonifanyia, ila naomba Mungu na ninaendelea kumuomba Mungu anisameheme, kwani hata vitabu vya Mungu vinakataza binadamu kutoana roho…hivyo tuiachie mahakama ndiyo itaamua,” alisema Ditopile. Baada ya kumaliza mazungumzo yetu siku hiyo ambayo taifa likikuwa likisherehekea uhuru wake, nilimuaga kwamba nakwenda, akanisii nisimtupe kwa sababu yupo jela, niwe napita kumjulia hali na kumpatia taarifa mbalimbali, nikamkubalia. Baada ya kuondoka gerezani hapo, kilichofuata, alikuwa akiletwa kwa nyakati tofauti katika Mahakama ya Kisutu na hatimaye Mahakama Kuu ambapo ndipo kituo changu cha kufanyia kazi. Machi 9, mwaka jana, viwanja vya Mahakama Kuu viligeuka kuwa uwanja wa mapambano kabla na baada ya aliyekuwa Mkuu wa Mkoa wa Tabora, Ukiwaona Ditopile Mzuzuri, kufikishwa mahakamani hapo na kutolewa kwa dhamana. Mapambano hayo yalifanywa na watu wanaosadikiwa kuwa ni ndugu wa mshitakiwa Ditopile dhidi ya waandishi wa habari waliokuwa wakifuatilia mwenendo wake. Nami nilikuwa mmoja wao. Machi 10, 2007 ambayo ilikuwa siku ya Jumamosi asububi, nikiwa na Mwadhiri Mwandamizi wa Sheria na Katiba wa Chuo Kikuu cha Dar es Salaam, Dk. Sengondo Mvungi, nilipokea simu ikisema: “Sura yangu mnaitakia nini au mmetumwa na waganga wenu muichukue mkaniroge?” Nikamuuliza aliyenipigia alikuwa nani, akanijibu kuwa: “ Ni mimi mzee wako Ditopile.” Nilicheka. Nikacheka sana, ila nikamweleza wazi kabisa kwamba sikufurahishwa na vurugu zilizofanywa na ndugu zake, kwani zilikuwa zikizuia waandishi wasifanye kazi yao, pia lionyesha kuwa familia yake ina watu wa namna gani. Akasema tumsamehe, na nilipomhoji ni kwanini anavaa kofia kubwa ‘pama’, alisema anaivaa kwa makusudi ili wapiga picha wasiipate sura yake kwa urahisi. Akaniambia kuwa: “Wewe ni mwandishi gani umeingia gerezani kuniona ukashindwa kupiga picha mazingira ya Gereza la Keko?” Nikamjibu kuwa nisingeruhusiwa. Akaniambia pamoja na sheria kukataza yeye alitumia mbinu zake za kijeshi na alifanikiwa kupiga picha mazingira ya gereza hilo na jinsi mahabusu wanavyolala na wala hajawahi kukamatwa na askari magereza na picha hizo amezihifadhi nyumbani kwake. Kwa wale wanaomfahamu marehemu, lazima watakubaliana nami kwamba Ditopile alikuwa ni mtoto wa mjini, mwenye kupenda masihara na mzaa, muwazi na mwongeaji kupita kiasi, na mara nyingi nilipokuwa nikionana naye au kuzungumza naye alikuwa akiniasa nipende kusali, kuishi vizuri na watu na alinisisitiza nijiendeleze kielimu, kwani elimu ndiyo mkombozi katika ulimwengu wa sasa. Pia aliniasa kufanya kazi kwa bidii na kwamba ujumbe huo niusambaze hata kwa vijana wenzagu.Aliniambia kuwa wakati akisoma Chuo Kikuu wakati wa likizo alikuwa na ubao wa kuuza mboga na matunda katika Soko la Ilala, hivyo alikuwa akifanya biashara hiyo. Pia aliwahi kuuza magazeti ya Daily News katika mitaa ya Masaki na Oysterbay. Na alisema kazi hizo zilikuwa zinamsaidia kuongeza kipato. Baada ya kuniambia kwamba aliwai kufanya kazi hizo, nilimwangalia usoni nikajikuta naangua kicheo kwa sauti ndani ya ofisi yake ya mkuu wa Mkoa wa Pwani. Akauliza: “Unacheka hizo kazi?” Akaniambia mwanangu hadi leo hii mnatuaona tunateuliwa kushika nyadhifa mbalimbali, mkae mkijua tumetoka mbali.” Hatukuishia hapo, tuliendelea kuwasiliana kwa simu na hata Januari 6 mwaka huu, baada ya yeye kusikia kwenye vyombo vya habari kwamba waandishi wa habari, Saed Kubenea na Ndimara Tegambwage, wamemwagiwa tindikali, alinipigia simu akasema yupo mkoani Lindi, akasema amesikitishwa na tukio hilo na kwakuwa haishi utani aliniambia wakati umefika sasa mapaparazzi tuanze kuvaa ‘pama’ kama yeye ili watakapotumwagia tindikali isituingie machoni. “Mapaparazzi anzeni kuvaa pama kama mimi ili mkimwagiwa tindikali isiwaingie machoni au wasilianeni na mimi niwaonyeshe duka niliponunua pama langu,” alisema. Niliishia kucheka. Ndugu msomaji mapema mwaka huu, baadhi ya vyombo vya habari viliripoti kwamba Ditopile alikuwa akiuza asali, na kweli hadi anafariki dunia alikuwa akifanya biashara hiyo, ambayo aliwahi kunieleza kwamba inamuingizia kipato kizuri. Baada ya taarifa hizo kutangazwa, alinipigia simu akiniambia kwamba: “Waandishi hamna dogo, mimi kuuza asali imekuwa nongwa?” Akaniambia mbona Mwenyekiti wenu wa Chama cha Wamiliki wa Vyombo vya Habari (MOAT), Reginald Mengi, anauza soda za Coca Cola amuandiki? Mbona bosi wako Freeman Mbowe anauza pombe kwenye ukumbi wake wa Billicanas auandiki? Nilishindwa kumjibu kwani nilicheka sana, akaniambia usicheke. Katika viongozi wa CCM hakika naweza kusema kiongozi ambaye nilikuwa naye karibu kikazi na aliyekuwa akinipa ushauri mbalimbali alikuwa ni Ditopile, alinichukulia kama mwanawe, hakika Ditopile nakulilia. Hakuwa na majivuno kama walivyo viongozi wengine, hata wakati alipokuwa Mkuu wa Mkoa wa Pwani nilipokuwa nikipata nafasi, nilikuwa nikipita kumsalimia ofisini kwake. Ni Ditopile huyu huyu, siku moja kabla ya aliyekuwa Waziri wa Mambo ya Nje na Ushirikiano wa Kimataifa katika utawala wa Awamu ya Tatu, Jakaya Kikwete, kwenda kujitangaza rasmi kugombea urais katika ofisi za Makao Makuu ya CCM Mkoa wa Pwani, Kibaha, alinipigia simu saa tatu usiku akiniambia: “Wewe si unataka ‘scoop’” (habari moto), akaniambia kesho saa mbili asubuhi panda gari kisha shuka stendi ya mabasi Kibaha. Nilipomuuliza kuna habari gani mbona hataki kuniambia, akaniambia Nimwamini yeye na kwamba kesho yake nifike bila kukosa. Kwakuwa nilikuwa nikimuamini na kumheshimu, kesho yake ambayo ilikuwa ni siku ya Jumapili, nilifanya hivyo nikapanda gari la kwenda Kibaha pale Ubungo, na kabla ya gari kuondoka Ubungo, alinipigia simu akiniuliza nilikuwa nimefika wapi, nikamweleza ndiyo tunaondoka Ubungo, akasema sawa. Lile gari lilipofika stendi ya Kibaha, ghafla nilipokea simu nyingine kutoka kwake akiniuliza nilikuwa nimefika wapi, nikamwambia nimefika stendi ya Kibaha, ilikuwa saa 3 asubuhi. Akaniambia nikodishe teksi nimwambie dereva anipeleke CCM Mkoa wa Pwani, nilifanya hivyo. Nilipoanza kuingia ile njia ya vumbi kuelekea kwenye ofisi hizo, nikaona kumepambwa bendera za CCM. Nikamuuliza yule dereva kulikoni? Akaniambia kuwa hata yeye alikuwa anashangaa. Nilipofika kwenye ofisi hizo za CCM saa nne asubuhi nikakuta wafuasi na viongozi wa CCM wametanda huku viti vikiwa vimepangwa na nikabahatika kumkuta mpiga picha wa TvT, sasa TBC, Chris, nikamuuliza kulikoni? Akaniambia Kikwete siku hiyo anakuja kujitangaza rasmi kwamba atagombea urais. Aidha, baada ya dakika chache, Ditopile akaniambia: “Umekwishafika?” Nikamjibu, ndiyo. Akasema: “Eh umekuta nini au umesikia nini?” nikamwambia nimeambiwa kwamba muda mfupi ujao Kikwete atatangaza rasmi azima yake ya kugombea urais, akasema ni kweli na akaniambia hiyo ndiyo ‘surprise’ yake kwangu na kamwe sitakuja kumsahau kwani tukio lile lilikuwa ni la kihistoria. Ni kweli sitamsahau. Wana CCM walitutangazia kwamba Kikwete angefika pale saa tano kujitangaza lakini alifika saa saba na nusu mchana. Na ilipofika saa sita Ditopile na alinitafuta na kunitambulisha kwa mkewe aitwaye Tabia, kasha tulisalimiana. Nakumbuka enzi za uwahi wake aliwahi kuniambia kwamba alikuwa akisumbuliwa na ugonjwa wa kisukari akawa anasema anafuata masharti yote ya daktari. Na alikuwa aishi utani, nakumbuka kuna siku nikiwa ofisini kwake Pwani nilimkuta anakunywa chai na mkate wa kumimina nikamuuliza kulikoni na mikate ya kumimina asubuhi, akasema ni miongoni mwa kitafunio anachokipenda. Nasema tukio hili sitalisahau kwakuwa lilihudhuriwa na wahariri na waandishi wa habari waandamizi kutoka kwenye vyombo vya habari Dar es Salaam na walianza kufika eneo hilo saa tano hadi saa saba. Baadhi ya wahariri walionikuta hapo walishikwa butwaa na kuniambia wewe umepataje taarifa hizo, nikawaambia kwa njia zangu hasa ukizingatia kipindi hicho nilikuwa bado mwandishi mchanga sana na hata nilivyoandika habari ya tukio lile nakumbuka habari ile nilinyimwa ‘by line’ na mhariri wangu bila sababu za msingi. Nakulilia Ditopile ambaye haupo tena nasi duniani, ila mazuri uliyoachia tutayafuata na kuyatekeleza kwa vitendo.Hata hivyo Ditopile kama walivyo binadamu wengine alikuwa na upungufu na udhaifu na mabaya yake, hatutayafuata. Mwanasiasa wa siku nyingi Ditopile amefikwa na mauti Jumapili iliyopita. Alifikwa na mauti katika Hoteli ya Hilux ya mjini Morogoro. Nimemfahamu Ditopile kwa miaka sita sasa na hadi sasa kuna baadhi ya watu ukiwaeleza kwamba Ditopile ana elimu ya chuo kikuu wanakukatalia kutokana mzaha wake. Ditolipe ndiye mwasisi wa msemo wa ‘halo halo’. Ambaye amekuwa akisema yeye si mtu wa kuja, bali yeye ni mzaliwa wa jiji hili na amezaliwa wodi ya ‘Makuti’ enzi hizo ilikuwa ndani ya Hospitali ya sasa Taifa ya Muhimbili. Ditopile aliitimu shahada ya kwanza katika Chuo Kikuu cha Dar es Salaam, mwaka 1973, aliajiriwa na Chama cha TANU kama Katibu Msaidizi, Makao Makuu. Na kutokana na utendaji wake mwaka 1980 alikwishafikia cheo cha Katibu Msaidizi Mkuu Daraja la Kwanza. Machi 1983, aliteuliwa kuwa Katibu wa Wilaya wa CCM katika wilaya za Serengerema na Tabora mjini. Nyota yake ilianza kung’ara, na mwaka 1982 alichaguliwa kuwa mjumbe wa Halmashauri Kuu ya CCM .Mwaka 1996 hadi 1997, aliteuliwa kuwa Naibu Katibu Mkuu wa CCM Bara. Ditopile alikuwa ni miongoni mwa vijana sita waliokuwa wameamua kujiunga na utumishi wa Chama cha Tanganyika African National Union (TANU) mara baada ya kuhitimu masomo ya chuo kikuu mwaka 1973. Baada ya kujiunga na utumishi wa TANU , Ditopile alijiunga na Chuo cha Itikadi na Propaganda Kivukoni, wakati ule kikiitwa Chuo cha Chama. Baada ya kumaliza mafunzo ya Itikadi na Propaganda, alirudi makao makuu ya chama, na hapo alipewa jukumu la kuanzisha maktaba ya CCM ambayo hadi leo ni ya chama tawala. Pia alikuwa ni mtumishi mwaminifu wa Jeshi la Ulinzi la Wananchi wa Tanzania (JWTZ). Wakati wa utumishi wake alikwenda katika Chuo cha Maofisa Monduli, alikochukua mafunzo ya uafisa wa jeshi. Pamoja na nyadhifa hizo , Ditopile aliwai kuwa mbunge wa Jimbo la Ilala katika miaka ya 1980. Aliteuliwa kuwa Naibu Waziri wa Ulinzi na Naibu Waziri wa Mawasiliano. Pia alipata kuwa mkuu wa Mkoa wa Pwani, Kigoma, Lindi, Dar es Salaam na Tabora. Ditopile alizaliwa Machi 7, mwaka 1948 katika Wilaya ya Ilala, mkoani Dar es Salaam. Alisoma Shule ya Msingi Mchikichini, Dar es Salaam kati ya mwaka 1956 na 1959. Mwaka 1960 hadi 1963, alisoma Shule ya Kati Magomeni, Dar es Salaam. Kati ya mwaka 1964 hadi 1967, alisoma Shule ya Sekondari ya Aga Khan, ambayo kwa sasa inajulikana kama Tambaza. Mwaka 1968 hadi 1969, alihitimu Kidato cha Sita katika Shule ya Sekondari Tanga. Julai 1970, alijiunga Chuo Kikuu cha Dar es Salaam na kuhitimu mwaka 1973. Lakini makala hii haita kamilika kama sitaandika kwamba marehemu Ditopile alikuwa ni rafiki wa karibu wa familia ya Rais Kikwete. Na hakuna ubishi kwamba katika uhai wake marehemu alikuwa ni miongoni mwa watu waliopigana kufa na kupona ili Kikwete ateuliwe na CCM kupeperusha bendera ya chama hicho katika kinyang’anyiro cha urais na katika uchaguzi mkuu wa mwaka 2005. Na kweli hilo walifanikiwa. Lakini naweza kusema bahati haikuwa upande wake, kwani ndani ya miaka miwili na miezi minne, tangu kijana wake Kikwete ashike kiti cha urais, Ditopile alikumbwa na kesi ya kuua bila kukusudia, na kusababisha kuandika barua ya kujiuzulu wadhifa wa mkuu wa moka. Pia katika kipindi hicho kifupi cha utawala wa kijana wake, Ditopile amekumbwa na mauti. Hivyo hakuweza kufaidi matunda ya utawala wa kijana wake. Ditopile anatarajiwa kuzikwa leo katika shamba lake lilipo Kinyerezi, Dar es Salaam. Ditopile sisi tulikupenda, lakini Bwana amekupenda zaidi. Mungu ailaze roho yako mahala pema peponi. Amina. Rwakibarila, J.: The three petitioners are No.1 Musa Hamisi Mkanga, No.2 Agnes Gideon Mollel and No.3 Happy Emmanuel Kivuyo. Their major prayer is the nullification of the election of respondent No.1 Godbless Jonathan Lema as a Member of Parliament (MP) for the Arusha Urban Constituency on behalf of the Chama cha Demokrasia na Maendeleo (CHADEMA) political party in the 2010 General Elections. Respondent No.2 is the Hon. Attorney General who was joined in this petition in his capacity as the principal legal adviser of the Government of the United Republic of Tanzania. All the three petitioners were represented by Messrs Alute Mughwai and Modest Akida, learned Counsel. And respondent No.1 was represented by Mr. Method Kimomogoro, learned Counsel. But respondent No.2 was represented by Messrs Timolin Vitalis, learned Principal State Attorney and Juma Masanja, learned State Attorney. There are two impressive witnesses in this petition who are using brave methods to struggle to earn their living and improve their standards of their lifestyles in this city of Arusha, irrespective of its high costs of living. One of them is PW.14 Omari Bokolo. He retired voluntarily from the Tanzania Peoples Defence Force (TPDF) in 1985, at the age of 35, already with the rank of the captain. After his retirement, he settled in Arusha and secured a track of land measuring 38 acres where he earns his living by cultivating maize and beans, sometimes through irrigation therein. That track of land is situated at Luis Nduruma ya Chini in Arumeru district and about 36 kilometers from this Arusha city centre. He spends most of his time at his farm house there but visits his home periodically along Makaburi ya Baniani area, in Unga Ltd Ward, within this city. Another typical impressive witness in this petition is PW.11 Amina Ali. She lives in a wedlock with her husband in Sokoni I ward in this Arusha city. During the subsistence of their marriage, she secured the capital from her husband which she uses to buy in whole sale old clothes popularly nicknamed “mitumba” or new ready-made clothes. From 10 a.m. up to 06 p.m. daily, she conducts shuttle trips in the Arusha city streets, selling those clothes to customers of various sources. She conducts that business like other unlicenced vendors who are countrywide colloquially termed “wamachinga” And there is a terminology which was often mentioned in proceedings of this petition. It is “malaigwanani”. According to petitioner No.3 cum PW.3 Happy Emmanuel Kivuyo, “malaigwanani” are prestigious men aged 40 years or above among the Waarusha and Wamasai tribes. Men of that type are capable of taking care of their families and keeping enough livestock. Therefore men of those tribes who can not support their respective families or keep livestock don’t fit to become “malaigwanani”. So that men of stray are automatically ruled out from the category of “malaigwanani”. Five political parties sponsored MP candidates for the Arusha Urban constituency in the said 2010 General Elections. Their names, respective political parties in brackets plus votes scored show that Joseph M. Mafuata (Demokrasia Makini) scored 179 votes and Yusufu Baalamay Garib (CUF) scored 456 votes. Others were Maximillian Elifatio Lyimo (TLP) scored 2,022 votes, Dr. Batilda Salha Burian (CCM) scored 37,460 votes and Godbless Jonathan Lema (CHADEMA) score 56,196 votes. That is why the CHADEMA candidate Godbless Jonathan Lema cum respondent No.1 was declared the MP for Arusha Urban Constituency. The election campaigns in that Arusha Urban Constituency were according to an Exhibit P.1 timetable, conducted from 20-08-2010 up to 30-10-2010. PW.4 Salum Mpamba who tendered it put it that it showed merely the timetable for MP seats candidates in that constituency. He was, during that campaign period, a CCM District Secretary for Arusha Urban Constituency. That timetable stretched on fifteen pages, each with six columns which show the date (in column No.1), the party (in column No.II), the ward (in column No.III), the place (in column No.IV), the time (in column No.V) and finally the nature of meeting (in column No.VI). The three petitioners in paragraph 7(a),(b),(c) and (d) of the petition averred that the election of respondent No.1 for that MP seat was void due to four illegalities which respondent No.1 did during that campaign period as follows. In paragraph 7(a) of the petition, the three petitioners averred that respondent No.1 made in the first batch illegal statements at four stations calling upon the electorate to refrain from voting for the CCM candidate Dr. Batilda Salha Burian on the ground that she was a woman who is married in Zanzibar and who, if elected, would go back to her husband and children in Zanzibar. Five witnesses for petitioners who testified in support of this ground are PW.1 Musa Hamisi Mkanga (petitioner No.1), PW.5 Arafa Mohamed, PW.9 Iddi Hussein, PW.11 Amina Ali and PW.12 Ramadhani Mohamed Senzige. PW.1 in his evidence on this ground testified that, he heard respondent No.1 stating words in the scope of that paragraph 7(a) at Cheka – Ung’atwe station in Sombetini Ward on the date which was not disclosed throughout his evidence. Therefore it is difficult to track from an Exhibit P1 timetable about where and when that meeting took place. For the purposes of this petition therefore, what were testified by PW.1 on this ground are accredited little weight. PW.2 in her evidence on that ground testified that she heard respondent No.1 stating words in the scope of that paragraph 7(a) at Elerai ward on 06-09-2010 at around 02.30 p.m. An Exhibit P1 timetable shows at its page 4 that, that meeting duly took place there. It follows that during the evaluation of the petitioners’ and respondents’ evidence, what transpired during that meeting shall be referred to as an event No.1. PW.9 in his evidence on that ground testified that he heard respondent No.1 stating words in the scope of that paragraph 7(a) at the same Eleroi Primary School on the same day of 06-09-2010 but at around 04 p.m. An Exhibit P1 timetable shows at its page 4 as well that, that meeting duly took place there. It follows that during the evaluation of the petitioners’ and respondents’ evidence, what transpired during that meeting shall be referred to as event No.2. PW.12 in his evidence on that ground testified that he heard respondent No.1 stating words in the scope of that paragraph 7(a) at Sombetini Street in Sokon I ward on the date which was not disclosed throughout his evidence. Therefore it is difficult to track from an Exhibit P1 timetable about where and when that meeting took place. And for the purposes of this petition therefore, what were testified by PW.12 on this ground are accredited little weight. On the basis of what have been clarified on allegations in paragraph 7(a) of the petition, events Nos.1 and 2 are fit for consideration and scrutiny later, during the evaluation of the petitioners’ and respondents’ evidence. In paragraph 7(b) of the petition, the three petitioners averred that respondent No.1 made in the second batch illegal statements at four stations exhorting a multiple of assembled “wananchi” not to vote for the CCM candidate because she was a woman and therefore unfit to be their representative leader. Four witnesses for petitioners who testified about five election campaign meetings in support of this ground are PW.1 Musa Hamis Mkanga (on two instances at one station), PW.6 Saidi Athumani, PW.5 Arafa Mohamed and PW.13 Gabriel Maleko. PW.1 in his evidence on this ground stated that he first heard respondent No.1 uttering words in the scope of that paragraph 7(b) at Mbauda street station in Sombetini ward on 18-09-2010 at around noon during the CHADEMA Presidential campaign meeting. An Exhibit P1 timetable does not cover that meeting because it was for the CHADEMA Presidential candidate meeting and not in the ambit of MP candidates’ meetings. It follows that, that meeting duly took place there and during evaluation of the petitioners’ and respondents’ evidence, what transpired during that meeting shall be referred to as an event No.3. PW.1 further testified in his evidence on that ground that he heard respondent No.1 stating words in the scope of that paragraph 7(b) at Kwa Mromboo station in Terrat ward on 31-08-2010 at around 04.30 p.m. An Exhibit P1 timetable shows at its page 3 that, that meeting duly took place there. It follows that later during the evaluation of the petitioners’ and respondents’ evidence, what transpired during that meeting shall be referred to as an event No.4. PW.5 in her evidence on that ground testified that she heard respondent No.1 stating words in the scope of that paragraph 7(b) at Elerai Primary School in Elerai ward on 06-09-2010 at around 02.30 p.m. An Exhibit P1 timetable shows at its page 4 that, that meeting duly took place there. It follows that during the evaluation of the petitioners’ and respondents’ evidence, what transpired during that meeting shall be referred to as event No.5. In his evidence PW.6 testified that he heard respondent No.1 stating words in the scope of that paragraph 7(b), again at Kwa- Mromboo in Terrat ward on an unspecified date at around 02 p.m. but in August, 2010. Therefore it is difficult to track from an Exhibit P1 timetable about where and when that meeting took place. For the purposes of this petition therefore, what were testified by PW.1 on this ground are accredited little weight. PW.13 in his evidence on that ground testified that she heard respondent No.1 stating words in the scope of that paragraph 7(b) at Makao Mapya area in Sokon I ward on 28-10-2010, at around 02.30 p.m. But an Exhibit P1 timetable did not disclose a meeting of that type at that venue during that time. As a result, it is difficult to track from an Exhibit P1 timetable about where and when that meeting took place. And for the purpose of this petition therefore, what were testified by PW.13 on this ground are accredited little weight. So that on the basis of what have been clarified on allegations in paragraph 7(b) of the petition, events Nos.3, 4 and 5 are fit for consideration and scrutiny during the evaluation of the petitioners’ and respondents’ evidence In paragraph 7(c) of the petition, the three petitioners averred that respondent No.1 made in the third batch illegal statements at two stations to incite religious sentiments of the potential voters against the said CCM candidate on the ground that she was a muslim. Only two witnesses for petitioners who testified in support of this ground are PW.1 Musa Hamisi Mkanga and PW.6 Saidi Athumani. PW.1 in his evidence deposed on this ground that he heard respondent No.1 stating words in the scope of that paragraph 7(c) at Kwa Mromboo area in Terrat ward on 31-08-2010 at around 04.30 pm. An Exhibit P1 timetable shows at its page 3 that, that meeting duly took place there. It follows that during the evaluation of petitioners’ and respondents’ evidence, that transaction shall be referred to as event No.6. PW.6 Saidi Athumani in his evidence on that ground testified that he heard respondent No.1 stating words in the scope of that paragraph 7(c) at Kwa Mromboo area in Terrat ward on the date which was not disclosed throughout his evidence. Therefore it is difficult to track from an Exhibit P1 timetable where and when that meeting took place. So that for the purposes of this petition, what were testified by PW.6 on this ground are accredited little weight. On the basis of what have been clarified on allegations in paragraph 7(c), event No.6 alone fits for consideration and scrutiny during the evaluation of the petitioners’ and respondents’ evidence. And in paragraph 7(d) of the petition, the three petitioners averred that respondent No.1 made in the fourth batch illegal false, immoral and scandalous statements against the CCM candidate Dr. Batilda Salha Burian that she was an adulterous woman and therefore unfit to be elected to the high and respected office of a Member of Parliament because she had borne a child by another male person and was presently heavy with a baby by that same person. Six witnesses for petitioners who testified in support of this ground are PW.1 Musa Hamisi Mkanga (petitioner No.1), PW.2 Agnes Gidion Mollel (petitioner No.2), PW.7 Joseph Silvesta, PW.8 Iddi Hussein, PW.10 Salvatory Christopher and PW.14 Omari Bokolo. In his evidence on this ground, PW.1 testified that he heard respondent No.1 stating words in an ambit of that paragraph 7(d) at JR Street station in Sombetini ward on 21-09-2010 at around 04 pm. PW1 put it that, the meeting which took place there was for the CHADEMA councellors’ seat candidate. It means that, that meeting is not reflected in an Exhibit P1 timetable. So that during evaluation of the petitioners’ and respondents’ evidence, that endeavour shall be referred to as event No.7. PW.2 Agnes Gidion Mollel in her evidence on that ground testified that she heard respondent No.1 stating words in an ambit of that paragraph 7(d) at Big – Sister station in Oloirien ward on 09-09-2010 at around 04 pm. But an exhibit P1 timetable shows that, that meeting took place there previously on 01-09-2010 (and not 09-09-2010). For the purposes of this petition therefore, what were testified by PW.2 on this ground are accredited little weight. Then PW.7 Joseph Silvesta in his evidence on that ground testified that he heard respondent No.1 stating words in an ambit of that paragraph 7(d) at Big Sister station at Oloirien Ward on 01-09-2010 at around 03.55 pm. An Exhibit P1 timetable shows at its page 3 that, that meeting duly took place there. It follows that during the evaluation of the petitioners’ and respondents’ evidence, that transaction shall be referred to as event No.8. And PW.8 Aggrey Shitaeni Mushi in his evidence on that ground testified that he heard respondent No.1 starting words in the scope of that paragraph 7(d) at Sekei Taxi Park station in Sekei Ward on 25-10-2010 at around 04 pm. That station was not recorded in an Exhibit P1 timetable because the campaign there, according to PW.8, was for Sekei ward CHADEMA counsellors’ seat candidate Mr. Chrispin Tarimo. Respondent No.1 was therefore, invited there to greet and address that meeting briefly. It follows that, during the evaluation of the petitioners’ and respondents’ evidence, that transaction shall be referred to as an event No.9. PW.10 Salvatory Christopher in his evidence on that ground testified that he heard respondent No.1 stating words in an ambit of that paragraph 7(d) at Ngwero station in Sombetini Ward on 26-08-2010 at around 04.30 pm. An Exhibit P1 timetable shows at its page 2 that, that meeting duly took place there. It follows that, during evaluation of the petitioners’ and respondents’ evidence, that transaction shall be referred to as an event No.10. Then PW.14 Omari Bokolo in his evidence on that ground testified that he heard respondent No.1 stating words in the scope of that paragraph 7(d) at Ngusero Mbugani station in Sombetini ward on 26-08-2010 at around 04 pm. An Exhibit P1 timetable shows at its page 2 that, that meeting duly took place there. It follows that during evaluation of the petitioners’ and respondents’ evidence, that transaction shall be referred to as an event No.11. On the basis of what have been clarified on allegations in paragraph 7(d) of the petition, events Nos. 7, 8, 9, 10 and 11 are therefore fit for consideration and scrutiny during the evaluation of petitioners’ and respondents’ evidence. In his defence, respondent No.2 the Hon. Attorney General (AG) through Messrs Timolin Vitalis, learned Principal State Attorney and Juma Masanja, learned State Attorney opted not to call any witness. These learned representatives of the Hon. AG opted merely to rely on the final submission at the end of hearing this petition. On his part, respondent No.1 Godbless Jonathan Lema staged the defence which was, in most of the material facts, similar with what was testified by his three witnesses namely RW.2 Viola Lazaro Likindikoki, RW.3 Gabriel Lucas and RW.4 Maringu Samson Mwigumba. In view of respondent No.1’s version, RW.3 was, inter alia, during the elections campaign period, CHADEMA Publicity Secretary for Arusha Urban District where Arusha Urban Constituency is situated. In course of that function, he was coordinating all sixty (60) election campaigns which respondent No.1 happened to address throughout the election campaign period, i.e from 20-08-2010 up to 30-10-2010. He was also the Master of Ceremonnies (MC) during those meetings. According to what both RW.1 and RW.3 deposed, the former (respondent No.1) never uttered any word calculated to exploit residence, gender or religions differences envisaged in paragraph 7 (a), (b) and (c) respectively of the petition. They put it too that respondent No.1 did not mention any scandalous words envisaged in paragraph 7(d) of that petition against the CCM political party candidate in Arusha Urban Constituency Dr. Batilda Salha Burian. During that endeavour, RW.1 and RW.3 gave evidence to connote that allegations from events No.1 up to 11 where respondent No.1 allegedly stated words in the scope of paragraph 7(a), (b), (c) and (d) of the petition were not true. It is important to note here that this court did not analyse each event which RW.1 and RW.3 referred to separately because, in their evidence, RW.1 and RW.3 did not always reveal the date and venue of those events. So that they mentioned dates or venues on few instances to wit, their narration can not be caused to tally with an Exhibit P1 timetable in this format of narration. The way RW.1 and RW.3 testified obviously cover events Nos.1 up to 11 which were referred to by witnesses for petitioners. This is the position because both RW.1 and RW.3 put it that they were jointly together, during all the CHADEMA MP political party election campaign meetings which RW.1 happened to address. RW.2 was sponsored by the CHADEMA political party to contest for Lemara ward counsellors’ seat. She deposed that she happened to attend eight CHADEMA political party election campaign meetings during that period. She put it that during those eight meetings, she didn’t hear respondent No.1 uttering illegal words envisaged in paragraph 7(a),(b),(c) and (d) of the petition. And RW.4 was during that period Arusha Regional Secretary for the CHADEMA political party. He deposed that he happened to attend five CHADEMA election campaign meetings during that period. He put it too that during the said five meetings, he didn’t hear respondent No.1 uttering words envisaged in paragraph 7(a), (b),(c) and (d) of the petition. There were ten issues which were framed at the commencement of hearing this petition. For convenience purposes, issues Nos 1, 2 and 4 shall be consolidated and dealt with jointly. But issue No.3 shall be dealt with alone. Then issues Nos 5, 6, 7 and 8 shall be consolidated and dealt with jointly too. As usual, issues No.9 and 10 which concern how to conclude the contentious matters in this petition and remedies for parties respectively shall be the last to be dealt with. Issue No.1 was, “Whether the petitioners have the cause of action against the first respondent”; Issue No.2 was, “Whether the petition is a representative suit, in terms of Order 1, Rule 8 of The Civil Procedure Code, Cap. 33 (Vol.1, R.E. 2002)”; and Issue No.4 was, “Whether the petitioners are legally recognizable agents of the CCM candidate Dr. Batilda Salha Burian, in terms of Order III, Rules 1 and 2 of The Civil Procedure Code, Cap. 33 (Vol. II, R.E. 2002)”. Issues Nos. 1, 2 and 4 on the face of it directly or impliedly tend to question whether the three petitioners had the locus standi to institute this petition. In order to show that petitioners had no powers to institute this petition, Mr. Kimomogoro, learned Counsel for respondent No.1 put it at page 4 of 60 pages final written submission that petitioners had a duty to set out the manner in which their rights or interests were breached or interfered with by reason of the statements allegedly made by the 1st respondent against Dr. Batilda Burian. Then at pages 8 and 9 of the same final written submission, this learned Counsel for respondent No.1 emphasized that a petitioner may come to court in the capacity of a recognized agent in terms of Order III, Rule 1 of The Civil Procedure Code, Cap. 33 (R.E. 2002) in terms of Rule 2(a) as recognized agents who are not advocates. It is a considered view of this court that the parent legislation in matters of elections exhaustively deals with the criterion of people who are competent to institute election petitions. So that under Section III (1) of The National Elections Act, Cap. 343, it is provided that an election petition may be presented by one, or more of the following persons namely – “(a) a person who lawfully vote or had a right to vote at the election to which the petition relates; (b) a person claiming to have had a right to be nominated at such election; (c) a person alleging to have been a candidate at such election; and (d) The Attorney General.” In the material petition, the petitioners therefore, have the statutory rights under Section III(1)(a) of The Elections Act (supra) to institute this petition. Their rights to institute the same, therefore, don’t necessarily rely on other legislations due to the simple reason that they averred in paragraph 2 of the petition that they were registered voters and were entitled to vote at the election to which this petition relates. Copies of their voters’ cards were annexed thereto and marked A(1-3). And that paragraph 2 is in the scope of matters which were found true by both the petitioners’ and respondents’ sides during the preliminary hearing (PH). It follows that issues Nos.1, 2 and 4 are answered in petitioners’ favour. Issue No.3 was, “Whether the petitioners had the duty to plead the actual words uttered by the first respondent during election campaign rallies specified in the petition.” In his final written submission at page 8, Mr. Kimomogoro, learned Counsel for respondent No.1 put it that petitioners were supposed to plead actual words allegedly uttered by respondent No.1 during election campaigns. He referred this court to Halisbury’s Laws of England, 3rd Edn. Vol. 24 at page 90 where it was pointed out that: “In order that the statement complained of as being a libel or slander may be construed or interpreted, it is essential that the actual words, not merely their substance, should be set forth verbatim in the statement of claim or indictment.” A matter resembling what was raised in issue No.3 was previously dealt with by my brother Hon. A.K. Mujulizi, J. who was my predecessor in this petition. And in his ruling of 26-09-2011, his Lordship correctly pointed out at page 12 of his well researched and reasoned ruling that what the petitioners pleaded in the petition was quite in order as it revealed sufficient facts to enable the first respondent to structure his defence. This court has no power and reason to differ with Hon. A.K. Mujulizi, J. on the same because he was, by that time, exercising jurisdiction at the same hierarchy like this court. Moreover Section 5(2)(d) of The Appellate Jurisdiction Act as amended by Section 2 of the Written Laws (Miscellaneous Amendments) Act, No. 25 of 2002 provides that: “No appeal or application for revision shall lie against or be made in respect of any preliminary or interlocutory decision or order of the High Court unless such decision or order has the effect of finally determining the criminal charge or suit”. And in addition, under Section 74(2) of The Civil Procedure Code, Cap. 33 (supra) as amended by Section 2 and the Schedule to The Written Laws (Miscellaneous Amendments) Act, No. 3 of 2002, it is provided that: “No appeal shall lie against or be made in respect of any preliminary or interlocutory decision or order of the High Court unless such decision or order has the effect of finally determining the suit”. This petition is, up to this stage of writing this judgment, still sub-judice before this court because Hon. A.K. Mujulizi’s ruling did not finally dispose it. And in view of provisions in both legislations which have just been cited above, his Lordship’s decision in that ruling can not be disturbed or altered by this court. Issue No.3 is therefore also resolved in favour of petitioners’ side. Issue No.5 was, “Whether during the election campaign rallies held in the constituency, the first respondent made statements against the CCM parliamentary candidate Dr. Batilda Salha Burian, a CCM candidate, that she was unfit to be elected as Member of Parliament for the constituency because she was married to a Zanzibari and who, if elected, would go back to her husband and children in Zanzibar; Issue No.6 was, “Whether during election campaign rallies, the first respondent made statements that were calculated to exploit gender differences between himself and a CCM candidate Dr. Batilda Burian; Issue No.7 was, “Whether during election campaign rallies, the first respondent made statements that were intended to exploit religions differences between himself and the CCM candidate Dr. Batilda Salha Burian; and Issue No.8 was, “Whether during election campaign rallies, the first respondent made defamatory statements against the CCM candidate Dr. Batilda Salha Burian that she was an adulterous woman who was not fit to be elected Member of Parliament because she had born a child out of wedlock and she had another pregnancy by the same man”. Respondent No.1 in his evidence denied uttering all illegal words which he allegedly made in paragraph 7(a) of the petition (in events Nos.1 and 2), paragraph 7(b) of the petition (in events Nos.3, 4 and 5), paragraph 7(c) of the petition (in event No.6) and paragraph 7(d) of the petition (in events Nos.7, 8, 9, 10 and 11). He was supported in his version by RW.2, RW.3 and RW.4. In a situation like that, this court could have opined that respondent No.1’s side rebutted the petitioners’ version. But the same is not the position because all the four witnesses who testified for respondent No.1’s side had rampant interests to serve, subject to results of this petition due to the following grounds. First, respondent No.1 who testified as RW.1, was also the CHADEMA political party Elections Campaign Manager for the Arusha Urban Constituency during the 2010 General Elections. He was, in addition, the MP candidate for that constituency under sponsorship of that party. Second is RW.2. She was the candidate for the counsellors’ seat for Lemara ward in that constituency. Third is RW.3 who is currently CHADEMA Publicity Secretary. He was a Master of Ceremonies (MC) during all sixty (60) election campaign meetings for CHADEMA MP candidate in that constituency which respondent No.1 addressed. And fourth is RW.4. He was that political party’s Publicity Secretary during the elections campaign period in 2010. He is currently CHADEMA’s Arusha Regional Secretary and simultaneously that party’s Chief Accountant at its headquarters in Dar es Salaam. Mr.Kimomogoro, learned Counsel in his written final submission at page 57 prayed on this court on behalf of respondent No.1 to dismiss this petition after he opined, inter alia, that there was no independent credible evidence to prove to the satisfaction of the court that the 1st respondent ever made prohibited statements at any of the nine campaign rallies in respect of which the petitioners adduced evidence. He opined further that the proven circumstantial evidence makes it highly improbable the making of such prohibited statements and, therefore the petitioners’ oral evidence must have been rehearsed and fabricated lies originating from PW.1 Musa Hamis Mkanga. And Messrs Timolin Vitalis, PSA and Juma Masanja, SA in their 30 pages final written submission added, at page 23 that, the police attended all the campaign meetings where the 1st Respondent is claimed to have made the defamatory and gender discriminatory statements. They clarified that there were no evidence to show that the 1st Respondent was ever arrested or interrogated for using discriminatory or abusive language in the campaign speeches. This court has taken into account what all learned Counsel and Attorneys for respondents Nos.1 and 2 respectively presented to try to exonerate respondent No.1 from allegations of uttering illegal statements during election campaign rallies. In addition to that, this court has further taken into account that respondent No.1 is a reputable person who was respectifully granted sponsorship by the registered CHADEMA political party to contest for the Arusha Urban constituency MP seat. This situation suffices for this court to warn herself on the same and then proceed to look into whether a person commanding distinguished credibility in the society like respondent No. 1 could have uttered those illegal words. Messrs Alute Mughwai and Modest Akida learned Counsel for petitioners in their 33 pages written submission at page 3 pointed out that petitioners’ eleven witnesses were credible because they were ordinary people who came from different backgrounds, social status like peasants, farmers, food vendors (mama lishe) and a retired army officer. Both learned Counsel for petitioners further pointed out that among petitioners’ witnesses, there were men, women, party and non party members and people of different religious faiths. In view of what were presented by learned Counsel and learned Attorneys for both sides, it is a considered view of this court that PW.1 could not have influenced all witnesses who testified for petitioners in this petition because it transpired in their examination in chief or cross-examination that he didn’t know most of them before the 2010 election campaign period. After he heard those witnesses stating their grudges about respondent No.1’s illegal statements, he led or directed them to the chambers of Mughwai & Co. Advocates where they voluntarily recorded their respective statements. It also transpired during cross examination of petitioners’ witnesses that they recorded their respective statements on different days, after travelling from different wards in Arusha Urban Constituency. Therefore from this background, it suffices to conclude that petitioners’ witnesses never got chances for joint rehearsals on what they stated at the chambers of Mughwai & Co. Advocates, when they visited there on different days from different sites for purposes of recording their statements. The petitioners’ version is added more weight by the evidence of PW.11 Amina Ali and PW.14 Omari Bokolo who were referred to earlier as impressive witnesses. On her party, PW.11 put it that she never belonged to any political party. According to her evidence, she was on a shuttle trip for purposes of selling clothes in form of a female “machinga”, when she arrived coincidentally at Miembeni street in Sokon I ward on 28-08-2010 at around 04.45 pm and happened to sight and hear respondent No.1 addressing the meeting and uttering the illegal words. But PW.11’s evidence was granted little weight because she mentioned the 28-08-2010 date, which was not reflected in an Exhibit P1 time table. Then there is another impressive witness PW.14 Omari Bokolo. He put it that he never joined any political party in his lifetime, although he retired from the TPDF in 1985 with the rank of Captain. He spends most of his time at his 38 acres farm, situated about 36 kilometers from the centre of this Arusha city where he cultivates maize and beans. He happened to visit his sister at Ngusero-Mbugani area on 26-08-2010 but when her sister was escorting him, he passed by coincidence at the site where respondent No.1 was addressing the election campaign meeting. This PW.14 clarified that at that juncture, when it was at around 04 pm on that day, he heard respondent No.1 uttering illegal words which constitute an event No.11. PW.14 in fact is more impressive to an extent that he disclosed that during his services with the TPDF, he managed to work at 42.KJ in Songea, 75.KJ in Arusha, Lugalo TPDF barracks, Msumbiji, Uganda and China. He sincerely disclosed that he resigned from the TPDF when he was briefly in Tanzania due to fear of what he stated in his own words that: “Hapa niliona kanafasi ka kuninyemelea kwenda tena nje kangenilenga tena na mwaka 1985 nikastaafu jeshi.” Therefore the petitioners’ witnesses like PW.14 or PW.11 had no reason or time to waste attending rehearsals on what to record in their respective statements at the chambers of Mughwai & Co. Advocates or later to testify before this court. It is a finding of this court that they freely testified on their own will about what they happened to sight and hear in what were earmarked as events Nos.1 up to 11. The claim that respondent No.1 was not arrested and charged of offences relating to mischiefs of his words don’t set-off what the petitioners’ witnesses testified. So that up to this juncture, respondent No.1 should consider himself lucky because in criminal prosecutions the time never runs against the Republic. In view of what were stated so far about evidence by the petitioners’ fourteen (14) witnesses, it has been proved satisfactorily that respondent No.1 uttered words which featured in events Nos.1 up to 11. It follows that what were stated by four (4) witnesses of respondent No. 1 are mere afterthoughts and rejected due to simple reason that all of them were found with interest to serve depending on the results for this petition. Next to consider is whether the words which respondent No.1 uttered in the category of events Nos.1 up to 11 suffice to reflect what were alleged in paragraphs 7(a),(b),(c) and (d) of the petition. Then the words which respondent No.1 uttered in the category of paragraph 7(a) of the petition were classified as events Nos.1 and 2. At event No.1, PW.5 heard respondent No.1 stating at Elerai Primary School in Elerai ward on 06-9-2010 at about 02.30 pm that: “Msichague kiongozi ambaye hayuko kwenye jimbo la Arusha. Kiongozi huyo makazi yake yako Zanzibar. Endapo mtamchagua akipata uongozi maendeleo yatakuwa hakuna katika jimbo la Arusha. Ataondoka kwenda kukaa Zanzibar pamoja na familia yake ya mume pamoja na watoto wake”. And at event No.2, PW.9 heard respondent No.1 stating at Elerai Primary School in Elerai Ward at around 04 pm that: “Ndugu wananchi msikubali kuletewa mtu kwa mapenzi ya mtu binafsi. Batilda Burian mimi namfahamu. Ameolewa Zanzibar. Ikifika kwenda kujifungua atatuachia jimbo na nani? At this era, it is a pride for most Tanzanians in the Mainland to stay in Zanzibar or get spouses there and vice versa. So that allegations in paragraph 7(a) of the petition that the CCM candidate Dr. Batilda Salha Burian was married to a Zanzibari did not constitute an illegal campaign. Therefore the petitioners’ allegations in paragraph 7(a) of the petition are dismissed. The words which respondent No.1 uttered in the category of paragraph 7(b) of the petition were classified as events Nos.3, 4 and 5. At event No.3, PW.1 heard respondent No.1 stating at Mbauda street grounds in Sombetini ward on 18-09-2010 that: “Tangu lini nyie waarusha mkaangozwa na wanawake”. Then at event No.4, PW.1 heard respondent No.1 stating at Kwa-Mromboo in Terrat ward on 31-08-2010 at around 04.30 pm that: “Jamani ee, tangu lini mmeona kwa mila zetu za Kichaga na Kiarusha mwanamke anaongoza malaigwanani? And at event No.5, PW.5 heard respondent No.1 stating at Elerai Ward on 06-09-2010 at around 04.30 pm that: “Waarusha msije mkakubali kuongozwa na mwanamke”. Then events Nos.3, 4 and 5 depict that respondent No.1 uttered words which are envisaged in paragraph 7(b) of the petition because they exploit gender differences. Respondent No.1 is therefore responsible for that illegality. The words which respondent No.1 uttered in the category of paragraph 7(c) of the petition were classified in event No.6. At that event No.6, PW.1 heard respondent No.1 stating at Kwa Mromboo in Terrat Ward on 31-08-2010 at around 04.30 pm that: “Chungeni sana wanaovaa viremba msije mkachagua alikaida”. There are currently some women in Tanzania who prefer to dress veils on their heads. Dressing in that manner mostly display that such women are decent to wit, that habit don’t fit to be associated with women with specific religious motives. Therefore the petitioners’ allegations in paragraph 7(c) of the petition are also dismissed. Then the words which respondent No.1 uttered in the category of paragraph 7(d) of the petition were classified as events Nos.7, 8, 9, 10 and 11. At event No.7, PW.1 heard respondent No.1 stating at JR street grounds in Sombetini ward on 21-09-2010 at around 04 pm that: “Dr. Batilda ameolewa Zanzibar. Mtakapomchagua atarudi Zanzibar kulea watoto wake na mume wake na nyie hamtakaa mmuone”. Then at event No.8, PW.7 heard respondent No.1 at Big Brother grounds in Oleorien ward on 01-09-2010 at around 03.55 pm stating that: “Asichaguliwe Dr. Batilda kwa kuwa ameolewa na Mzanzibari. Na hapa alipo Dr. Batilda anayo mimba ya Lowasa. Akichaguliwa Dr. Batilda atafunga radio Safina na kujenga msikiti mkubwa. Mkimchagua badala ya kuwawakilisha bungeni atakuwa matenite Zanzibar”. At event No.9, PW.8 heard respondent No.1 stating at Sekei Taxi park ground in Sekei ward on 25-10-2010 at around 04 pm that: “Mgombea wa CCM Dr. Batilda hafai kuchaguliwa kwa sababu ameletwa na hawara wake Lowasa na ni mjamzito. Sasa tukimchagua ataenda Bungeni au kulea mtoto”. And at event No.10, PW.10 heard respondent No.1 stating at Ngusero area in Sombetini ward on 26-08-2010 at around 04.30 pm that: “Ngoja niwaeleze udhaifu wa huyu mama Batilda Burian. Kwanza huyu mama sio mwaminifu. Na ana ujauzito wa Mzee wa Monduli. Mama huyu hatufai kukamata nafasi kama hii ya heshima katika jiji la Arusha. Kwa mtaji huu, nimebakizwa kuapishwa. Vyama vingine ni wasindikizaji.” Then finally in event No.11, PW.14 heard respondent No.1 stating at Ngusero Mbugani ground in Sombetini ward on 26-08-2010 at around 04 pm that: “Sasa ngoja niwaambieni. Huyu mwanamke anayegombea ubunge hapa Arusha mjini kwanza sio mwaminifu katika ndoa yake. Amezaa mtoto nje ya ndoa na Mheshimiwa Lowasa.” The events Nos. 8, 9, 10 and 11 depict that respondent No.1 uttered words which are envisaged in paragraph 7(d) of the petition because they display scandalous statements against the CCM candidate Dr. Batilda Burian. Respondent No.1 is therefore also found responsible for that illegality. Then issue No. 9 was, “Whether if issues Nos 5 - 8 or any of them are proved, suffice for voidance of election of first respondent as a Member of Parliament for Arusha Urban Constituency.” In fact what was established above shows that the petitioners failed to adduce sufficient evidence to prove adequately allegations in paragraph 7(a) and (c) of the petition. Instead, the petitioners have established adequate evidence to prove allegations in paragraph 7(b) and (d) of the petition. Under Section 108(1)(a) of The National Elections Act (supra) it is provided, inter alia, that the election of a candidate as a Member of Parliament shall be declared void if any of the following grounds is proved to the satisfaction of the High Court and on no other ground, namely – “That, during the election campaign, statements were made by the candidate, or on his behalf and with his knowledge and consent or approval with intent to exploit tribal, racial or religious issues or differences pertinent to the election or relating to any of the candidates, or, where the candidates are not of the same sex, with intent to exploit such difference.” In the material petition it has been proved satisfactorily that the person of respondent No.1 is the one which physically uttered statements in the scope of paragraph 7(b) of the petition (events Nos.3, 4 and 5) and paragraph 7(d) of the petition (events Nos.7, 8, 9, 10 and 11). It means respondent No.1 uttered during election rallies statements during eight events which were proved satisfactorily. Under that section 108(2) of The Elections Act (supra) any of those events could have sufficed to move this court to declare his election void. On that basis this court is hereby declaring void the election of respondent No.1 Godbless Jonathan Lema as Member of Parliament for Arusha Urban Constituency during the 2010 year General Elections. Issue No. 10 was, “What are remedies of parties”. It has been proved satisfactorily that respondent No.1 alone uttered illegal statements during eight events during election campaign rallies. In fact respondent No.2 or his agents were not linked in any manner with respondent No.1’s illegal statements. Therefore three orders are ultimately made as follows. The election of respondent No.1 Godbless Jonathan Lema as a Member of Parliament for Arusha Urban Constituency in the 2010 year General Elections is declared void. Respondent No.1 alone is condemned in costs to wit, he shall shoulder costs for all three petitioners; and The Hon. District Registrar for Arusha High Court Zone should immediately facilitate communication with the Director of Elections about this court’s decision in compliance with Section 114(1)–(7) of The National Elections Act (supra). IBARA ya 107A.(1) ya Katiba ya Jamhuri ya Muungano wa Tanzania ya mwaka 1977, inasema “ Mamlaka ya yenye kauli ya mwisho ya utoaji haki katika Jamhuri ya Muungano itakuwa ni Mahakama.


Wakati Ibara ya 107B ya Katiba hiyo inasema; “ Katika kutekeleza mamlaka ya utoaji haki, mahakama zote zitakuwa huru na zitalazimika kuzingatia tu masharti ya Katiba nay ale ya sheria za nchi.

Ieleweke wazi pindi mahakama inapotoa maamuzi yake ni lazima maamuzi yale yaheshimiwe na yatekelezwe na endapo maamuzi yale hayatatekelezwa,mahakama inaweza kutoa amri ya kumwadhibu mhusika ambaye ambeye ameidharau amri hiyo ya mahakama.Na upande mmoja katika kesi ambao unaona haujaridhishwa na maamuzi ya mahakama ya ngazi fulani basi upande huo unaruhusiwa kukata rufaa katika mahakama za juu.

Nimelazimika kutumia nukuu hiyo ya ibara za Katiba na maelezo hayo kwasababu makala yangu ya leo itajadili mwenendo usiopendeza unaozidi kufanywa na baadhi ya wananchi wenzetu hususani baadhi ya wanasiasa na wafuasi wao ambao wamekuwa na kasumba ya kutoa maoni yao yanayo lenga kukashfu hukumu mbalimbali zinazotolewa na mahakama bila ya kutoa ushahidi mbadala ili mahakama na umma uweze kufahamu kweli hukumu hizo zilizotolewa na mahakama zetu zinakasoro, ama zilikuwa na lengo la kupendelea upande mmoja na kuumiza upande mwingine.

Kwa sisi baadhi ya waumini wa sheria na tunaofutilia baadhi ya mashauri mbalimbali yalipo katika mahakama zetu kwa kuudhuria kesi hizo mahakamani, tungali tukikumbuka Agosti 2009, Jaji wa Mahakama Kuu Kanda ya Dar es Salaam, ambaye kwa sasa ni Jaji wa Mahakama ya Rufaa nchini, Salum Masati alitoa hukumu ya kesi ya mauaji ya watu wanne iliyokuwa ikimkabili aliyekuwa Kamanda wa Polisi, Mkoa wa Rukwa, Kamishna Msaidizi wa Polisi(ACP), Abdallah Zombe na wenzake tisa, ambapo aliwaachilia huru washtakiwa hao kwa maelezo kuwa ushahidi uliotolewa na upande wa Jamhuri ni dhaifu na akaliagiza jeshi la polisi likawatafute wauaji wa watu hao.

Itakumbukwa kuwa baada ya kutolewa hukumu hiyo wananchi mbalimbali wakiwemo wanaharakati,vyombo vya habari walitoa maoni yao wakiishutumu wazi wazi mahakama na kuonyesha hawakuridhika na hukumu hiyo na kwamba Zombe alistahili kuhukumiwa kunyongwa.

Lakini kwa kuwa ofisi ya Mkurugenzi wa Mashtaka ambayo kwasasa inaongozwa na Dk.Elizer Feleshi ina uweledi wa masuala ya kisheria na ndiyo imepewa jukumu la kuendesha kesi za jinai mahakamani, baada ya hukumu hiyo kutolewa ilikaa chini na kuisoma nakala hiyo ya hukumu bila kubwatuka mitaani na hatimaye ikafikia uamuzi wa kukata rufaa kwa kufuata taratibu zote za kisheria licha hadi sasa rufaa hiyo bado haijaanza kusikilizwa.

Mfano mwingi hai ni ile hukumu iliyotolewa mwaka 2010 ya rufaa ya kesi ya Kikatiba iliyofunguliwa katika Mahakama ya Rufaa na Mwanasheria Mkuu wa Serikali dhidi ya Mchungaji Christopha Mtikila, ambapo Jaji Mkuu Mstaafu Agustino Ramadhani ambaye alikuwa akisaidiwa na jopo la majaji sita wa mahakama rufaa, walitengua hukumu ilitolewa na Mahakama Kuu mwaka 2004 ambayo iliruhusu kuwepo kwa mgombea binafsi kuanzia ngazi ya Ubunge na Urais.

Nayo hukumu hii ilizusha gumzo katika jamii yetu kwani baadhi ya makundi mbalimbali ya kijamii,wanasiasa na sisi waandishi wahabari walitoa maoni yao hadharani kutokufurahishwa na hukumu hiyo na wengine walisema majaji hao ni wasaliti ‘Yuda eskari yoti’ wa watanzania na kwamba hukumu hiyo waliiandika kutokana na maelekezo waliyopewa na serikali kwani serikali haitaki mgombea binafsi.

Na waliokuwa wakipinga hukumu hii hata siku moja hawajawahi kumtafuta Mtikila kumpatia hata nauli ili iwe inaweza kumuwezesha kwenda kuudhulia kesi hiyo mahakamani au kumchangia fedha Mtikila ili aweze kumlipa wakili wake Mpare Mpoki. na wengine walikuwa wakimwita Mtikila ni mwendawazimu.

Na mfano mwingine ni hukumu iliyotolewa Aprili 5 mwaka huu, ya kesi ya kupinga ubunge wa Mbunge wa Jimbo la Arusha Mjini(Chadema),Godbless Lema ambayo ilifunguliwa na wapiga kura watatu wa jimbo hilo akiwemo Happy Kivuyo na Mussa Mkanga katika uchaguzi mkuu wa mwaka 2010.

Jaji Gabriel Rwakibarila akisoma hukumu yake alisema baada ya kupitia ushahidi wa pande zote mbili ameridhika na ushahidi ulitolewa na walalamikaji na kwamba anamtia hatiani Lema kwa madai yaliyokuwa yanamkabili Lema yakiwemo ya kumtolea maneno ya kumdhalilisha na kumkashifu aliyekuwa mgombea wa CCM,Dk.Batrida Buliani na kwa maana hiyo anatengua ubunge wake na kwamba wadaiwa wanayo haki ya kukata rufaa.

Kama ilivyoada baada ya hukumu hiyo kutolewa tumeshuhudia kupitia vyombo vya habari vikimnukuu Lema,wafuasi wake na baadhi ya viongozi wengine wa Chadema wakitoa maoni yao kuhusu hukumu hiyo ambayo hata bado hawajaisoma kwasababu hawajapatiwa nakala yake, wakitoa maneno ya kuikashfu mahakama kuwa hukumu hiyo ni maelekezo toka Ikulu na kwamba hukumu hiyo ni mbaya itasababisha wananchi waanze kuondoa imani na mahakama zetu.

Kwa mifano ya hukumu hizo na maoni hayo ya watu walizipinga hukumu hizo huku wengi waliozipinga hukumu hizo hawajapata fursa ya kuzisoma nakala za hukumu hilo, ni wazi wananchi hao kabla ya hukumu hizo kutolewa tayari walikuwa na hukumu zao vichwani mwao kitendo ambacho kipingana na Ibara hizo mbili za katiba ambazo zimezitaja hapo juu.

Binafsi sijaisoma nakala hiyo ya hukumu ili kujua Jaji Rwakibarila alitumia vigezo gani vya kisheria hadi akafikia uamuzi huo, na kwa sababu mimi ni muumini wa sheria katu siwezi kuwa na jeuri ya kutolea maoni kuhusu hukumu hiyo kwasababu sijaisoma .

Ndiyo maana kimsingi makala yangu ya leo haitajadili kilichomo kwenye nakala ya hukumu ya Lema, la hasha nitajadili tabia hiyo ya baadhi ya wananchi wenzetu ambao wamekuwa vinara wakutoa maoni yao ambayo yanatoa hitimisho la ama kumshutumu jaji au hakimu aliyetoa hukumu ya kesi fulani ambayo hukumu hiyo haijawafulahisha na mahakama kwa ujumla.

Tuwaulize hawa wananchi wenzetu ambao tumewashuhudia wakisema hukumu ya Lema ilipangwa na Ikulu, mara viongozi wa CCM bila kuisoma hukumu ile hivi wana akili timamu?

Na kama wana akili timamu ni kwanini wanashindwa kuheshimu matakwa ya ibara hizo za Katiba nilizozitaja hapo juu?Hivi wanafahamu kuwa kauli hizo wanazozitoa kuhusu hukumu hiyo ya Lema kuwa hukumu hiyo ya Lema kuwa ilivuja kabla haijasomwa, jaji alipewa maelekezo na Rais Jakata Kikwete,viongozi wa CCM, zinaweza kuwaingiza matatani pindi vyombo vya dola vikiamua kuwakamata wale wote walitoa kauli za aina hiyo na kuwafikisha mahakamani kwa makosa ya jinai ili waende kuithibitishia mahakama ukweli wa madai hayo wanayoyasema kupitia vyombo vya habari?

Maana ni sisi wenyewe Watanzania tumeridhia nchi yetu ingozwe kwa utawala wa sheria,sasa ni kwanini leo hii miongoni mwetu hatutaki kuzitii na kuziheshimu sheria hizo?

Nyie wenzetu ambao baada ya hukumu ya Lema kutolewa ndiyo mmeibuka na kusema mahakama imemuonea Lema kwasababu ushahidi uliotolewa kwa maoni yenu hautoshi kutengua ubunge wa Lema, ni nani amewapa mamlaka hayo ya kimahakama ya kutoa hukumu katika kesi hiyo?

Kama mnafikiri mlikuwa na ushahidi mzito ambao mlikuwa mkitembea nao mifukoni mwenu kuhusu kesi hiyo ya mpendwa wenu, na kama kweli mlikuwa mnataka Lema ashinde kesi hiyo, ni kwanini basi kipindi kile kesi hiyo inataka kuanza hamkufuata Lema na kumuomba awaweke kwenye orodha ya mashahidi wake ili nanyie mpande kizimbani mtoe ushahidi ambao mwisho wa siku labda ungeweza kuishawishi mahakama imuone Lema hana hatia?

Kama mnasema hukumu ile ilivuja mapema kabla ya kusomwa, mbona nyie mnaosema hivyo na nyie hamkuitisha mkutano na vyombo vya habari au kwenye uongozi wa mahakama kulisema hilo mapema ?Na kama hukumu hiyo ilivujishwa mapema mbona hakuna hata mmoja aliyejitokeza adharani kabla ya jaji Rwakibarila kusoma hukumu yake kutuonyesha hukumu hiyo anayodai imevuja ili tumwamini?

Mbona hao wanaotueleza hukumu hiyo ilivuja mapema,ndiyo hao hao wanatuambia kuwa wanasubiri waipate nakala ya hukumu iliyotolewa na Jaji Rwakibarila waisome ndiyo waone kama wanaweza kukata rufaa au la?

Mbona hivi karibuni tu Mbunge wa Ilemela(Chadema), Hynesi Kiwia alishinda kesi ya kupinga matokeo ya yalimtangaza yeye kuwa mbunge, iliyokuwa imefunguliwa na wanachama wawili wa CCM, katika Mahakama Kuu ya Mwanza.

Kabla ya hapo baada ya uchaguzi wa mwaka 2005, aliyekuwa mbunge wa Karatu(Chadema), Dk,Wilbroad Slaa alishinda kesi ya kupinga ubunge wake iliyofunguliwa na aliyekuwa mgombea wa jimbo hilo kupitia CCM, Patric Tsere katika Mahakama Kuu Kanda ya Arusha, na Jaji Robert Makaramba alitupilia mbali kesi hiyo iliyofunguliwa na Tsere na kuamuru Dk.Slaa aendelee kuwa mbunge, mbona hatukusikia hao wanaoilalamikia hukumu ya Lema, wakipiga kelele kupinga hukumu hizo hadharani na kumwaga machozi hadharani kwenye Televisheni kama sio unafiki na ujuha uliokubuhu nini?

Na mbaya zaidi wanaofanya mchezo huo wa hatari ni wasomi na ni watu wazima na watoto majumbani wanasikilizwa na kutazamwa na baadhi ya wananchi wanaziamini kauli zao,jambo ambalo nasema ni hatari kwa ustawi wa utawala sheria hapa nchini na kuushushia heshima mhimili wa mahakama kwa namna moja ama nyingine vitendo hivyo vinaingilia uhuru wa mahakama ambao umeitolewa kwenye Ibara 107 B ya Katiba.

Wakati umefika sasa kwa Jaji Mkuu Mohamed Chande Othman na timu yake ya mahakama kuamka usingizini na kutetea heshima ya mhimili wa mahakama kwani endapo wataruhusu vitendo hivyo vinavyofanywa na baadhi ya wananchi wenzetu basi wajiandae kuona siku wananchi ambao hatafurahishwa na hukumu kadhaa wakivamia mahakama au majaji na mahakimu na kuwapiga kizimbani.

Hisia kwamba hukumu hiyo ilipangwa bila kutupatia ushahidi waliopanga hukumu hiyo ni wakinanani na ni kwanini watu hao waitie mikono kwenye hiyo tu na si kwenye kesi nyingine kamwe haitamsaidia Lema,hivyo ni vyema basi Lema kama anaona ipo haja ya kukata rufaa akaae chini na wakili wake wakate rufaa na kama hawaoni haja ya kukata rufaa basi wasikate rufaa kuliko hivi sasa kunukuliwa akitoa maneno ya aina hiyo ambayo si moja ya mambo yaliyokuwa yakilalamikiwa kwenye kesi yake kwani mwomba rufaa anakata rufaa utakiwa kutoa sababu za kukatia rufaa hukumu iliyotolewa na mahakama ya chini na siyo porojo na hisia za barabarani.

Nimalizie kwa kumpa pole na kumuasa Godbles Lema na hao wanaojifanya wamepatwa na uchungu kutokana na hukumu hiyo ya kesi , kuwa makini na kauli zao wanazozitoa mara baada ya hukumu hiyo kutolewa kwasababu serikali inaweza kuwachukulia hatua.

Na Lema naomba ukumbuke kuwa wewe bado unakabiliwa na kesi mbili za jinai hapo hapo jijini Arusha, sasa unapotoa kauli kama hizo ambazo ni wazi zinaupaka matope mhimili huo wa mahakama ambao ni wenyewe pekee ndiyo umepewa mamlaka ya kutoa haki katika mashauri mbalimbali hapa nchini, ulipaswa utafakari kabla ya kutoa kauli kama hizo kwasababu kesi hizo zinaendelea kusikilizwa na mhimili huo huo ambao wewe na wafuasi wako mnaushutumu kuwa unatoa hukumu kwa kupewa maelekezo na Ikulu.Lema kumbuka wahenga walisema ‘ usidharau mkunga wakati uzazi ungalipo”.

ZITTO KABWE,MBONA U MSAHAULIFU?

SISI Wanyambo ambao ni wenyeji wa wilaya ya Karagwe mkoa wa Kagera tunamsemo mmoja maarufu usemao; “Omusheija ainduka aha Kitanda,tainduka aha lulimi’.


Kwa tasfiri ya lugha ya Kiswahili maana yake ni kwamba “Mwanaume ana geuka kitandani,habadilishi kauli aliyokwisha itoa mdomoni mwake.Yaani akisema amesema.”

Nimelazimika kutumia msemo huo kwasababu makala yangu ya leo itajadili kauli zinazokinzana zilizotolewa na mtu mmoja kwa nyakati tofauti na mtu huyo si mwingine ni Naibu Katibu Mkuu wa Chama cha Demokrasia(CHADEMA), Zitto Kabwe, kuhusu mawaziri wa wanaotaka kuwania urais mwaka 2015 wafukuzwe kazi na kauli zake mwenyewe kuhusu kauli zake za kinafki na sitaki nataka wadhifa wa urais mwaka wa Tanzania.

Gazeti la Tanzania Daima Jumapili toleo la Novemba 28 mwaka 2011, ilikuwa na kichwa cha habari kisemacho ; “ Zitto awalipua mawaziri, asema hawafanyi kazi,wanauwaza urais”.

Habari hiyo ilisomeka hivi,Naibu Katibu Mkuu wa Chama cha Demokrasia na Maendeleo (CHADEMA), Zitto Kabwe, amemtaka Rais Jakaya Kikwete kuwafukuza kazi mawaziri wake tisa wanaotaka kuwania urais kupitika chama hicho mwaka 2015.

Bila kuwataja majina mawaziri hao, Zitto alisema hivi sasa hawafanyi kazi ya kujenga uchumi wa nchi na badala yake wamejiingiza katika ‘vita’ ya kuwania uongozi huo.

Kauli hiyo aliitoa Novemba 27 mwaka jana jijini Dar es Salaam mara baada ya kufungua mkutano wa Muungano wa vyama vya Kidemokrasia Afrika (DUA) uliojumuisha vijana kutoka katika nchi 22 ambapo Baraza la Vijana la CHADEMA (BAVICHA) ndio wenyeji.

Zitto alisema uchumi wa Tanzania umeporomoka na kufikia asilimia 17, hali ambayo imesababishwa na mawaziri wa serikali ya Rais Jakaya Kikwete kushindwa kufanya kazi kikamilifu.

Alisema kwa sasa hali ya nchi ni mbaya ukilinganisha na wakati wa utawala wa Rais Benjamin Mkapa, ambapo uchumi ulishuka kwa asilimia 4.5 na mfumuko wa bei ulidhibitiwa kwa kiwango kikubwa.

Aidha Machi 1 mwaka 2012:Gazeti hili la Tanzania Daima lilikuwa na kichwa cha habari kisemacho; “Nikiombwa nitagombea urais-Zitto”

Zitto katika habari hiyo alinukuliwa akisema kuwa ikiwa chama chake kitaona kuwa anafaa kuwania nafasi ya urais ama nyingine yoyote, hatasita kupokea wajibu huo.
Lakini Gazeti la Mwananchi Jumapili la Machi 25 mwaka huu, lilichapisha habari iliyokuwa na kichwa habari kisemacho “Zitto: Nitagombea urais 2015”.

Katika taarifa yake aliyoituma katika gazeti hilo Zitto alisema; “ Kwanza atakayekabili changamoto hizi. Ninaamini ninaweza kuwaongoza Watanzania wenzangu kukabili changamoto hizi.”

Alitamba anao uwezo kwa kuwa ni mzalendo, mwenye utashi wa kuleta mabadiliko stahiki kulingana na nchi inavyoongozwa. Katika taarifa hiyo ameeleza kuwa kwa sasa nchi imesahau maendeleo ya watu badala yake imejikita katika maendeleo ya vitu.

Kwa mtiririko huo hapo juu wa kauli za Zitto alizozitoa katika tarehe tofauti na magazeti tofauti na kwamba hadi leo hii naandika makala hii sijaona wala kumsikia Zitto akikanusha kauli zake hizo, ni wazi zimenipa msukumo wa kuweza kujadili kauli hizo ambazo kwa mtizamo wangu nadiriki kuziita ni kauli zinazo kinzana ambazo zinatoka kinywa cha mtu mmoja.

Kwanza Ikumbukwe kuwa Katiba ya Jamhuri ya Muungano wa Tanzaia ya mwaka 1977 , inatoa haki kwa wananchi wake ya kuchagua au kuchaguliwa.Lakini kwenye kiti cha urais, Ibara ya 39(1) (b) ya Katiba hiyo inasema ‘Mtu hatastahili kuchaguliwa kushika kiti cha urais wa Jamhuri ya Muungano , isipokuwa tu kama; ametimiza umri wa miaka arobaini.

Kama Novemba 27 mwaka jana, Zitto alinukuliwa akiwatuhumu mawaziri wa serikali ya awamu ya nne inayoongozwa na Rais Jakaya Kikwete ambao mawaziri wote hao ni wanachama wa CCM, watimuliwe kazi bila kuwataja majina yao kwasababu hawafanyi kazi wanauwaza urais wa mwaka 2015 , halafu Machi 25 mwaka huu, Zitto huyu huyo anaibuka na kusema anautamani rais na kwamba anasifa za kuwa rais.

Kwa kweli baada ya kumsikia akitoa tamko hilo , binafsi nilimshukuru mwenyezi Mungu kwa ameweza kufanyakazi yake ya kuanza kufanyakazi yake ya kutuonyesha sisi waje wake ili tufumbuke macho na tuone kuwa Zitto kumbe na yeye ni jamiii ile ya baadhi ya wanasiasa wale wale wenye hulka za kinyang’au ambao wanakasumba ya kuzungumza uongo mbele ya umma, ili umma uwapende na uamini kuwa kiongozi huyo ni mtu safi na mtetezi wa wanyonge, kumbe siyo kweli.

Kwa watu tunaofuatilia matendo na kauli za viongozi wetu wa kitaifa, uwa tunatunza akilini na maktaba zetu baadhi ya matamshi wanayoyatoa kwa lengo ya kuzisoma na kujifunza kama nitaona zina mantiki ndani yake.

Ieleweke wazi hapo nyuma Zitto alitokea kujizolea umarufu mkubwa ndani ya jamii kwa kile kilichoelezwa ni mwanasiasa kijana ambaye ana misimamo thabiti na asiyeyumba katika kile anachikiami.

Lakini hivi sasa kadri siku zinavyozidi kwenda ule mvuto aliokuwa nao awali umeanza kutoweka kwa sababu mbalimbali ambazo binafsi bado sijazithibitisha ila baadhi ya wanananchi mitaani na wengine ni wanachama wenzake wamekuwa wakieleza kuwa Zitto hana usafi wowote,anakisariti chama chake na kwamba yupo pale kwaajili ya kutaka kukivuruga chama.Na kwamba viongozi wa chama chake wameishamfahamu wanachokifanya ni kumpuuza.

Sisi waumini wa sheria tunasema tuhuma zitabaki kuwa tuhuma hadi pale zitakapothibitika na mahakama au vikao husika vya chama chake.Lakini kwa kuwa mungu ni mwema kadri siku zinavyozidi kwenda mbele atazidi kutuonyesha kama kweli Zitto ni mwanasiasa msafi ,mhadilifu kuliko wanasiasa wenzake wanaotoka katika vyama mbalimbali vya siasa.

Na kwa kuanzia naona mungu ameanza kutufunulia kuwa naye Zitto ana tabia ile ile ya wanasiasa wenzake ambao leo wanapinga jambo hili lisifanywe na wanasiasa wenzao lakini kesho yeye anaibuka na kufanya jambo hilo hilo na wakati akifanya jambo hilo analialalisha yeye kulifanya ni halali ila wenzie wakifanya siyo halali. Kama siyo ubinafsi,unafiki na uchonganishi nini?

Zitto alitaka mawaziri watimuliwe kazi kwa kitendo chao cha kuwaza urais wa mwaka 2015 licha hadi sasa hakuna waziri yoyote alijitokeza adharani akatangaza nia ya kugombea au kukiri kuwa ana uwaza au anautamani urais kama alivyofanya yeye.

Tumuulize Zitto tukimuita yeye ni mbinafsi na mnaki na muongo tutakuwa tumekosea?

Maana yeye Zitto aliuambia umma kuwa kuna mawaziri tisa bila kuyataja majina yao wanautaka urais na eti watimuliwe kazi, lakini yeye baadaye akaibuka na kusema akiombwa na chama chake agombe atagombea na baadaye katika kipindi kifupi hata chama chake hicho akijamuomba wala kumpa ridhaa akiibukia kwenye gazeti la Mwananchi na kusema anautamani urais na kwamba ana sifa.

Kama hivyo ndivyo hatuoni Zitto ana kasumba ya ubinafsi ambayo anataka apate yeye wenzie wasipate?Mawaziri wakiuwaza urais yeye kwake ni haramu ila yeye akiutamani urais tena adharani siyo haramu?

Zitto ulipendekeza mawaziri hao tisa watimuliwe kazi licha mawaziri hao hawajajitokeza adharani kama wewe kutangaza nia, Sasa Je na wewe wafuasi wa Chadema wamuombe Mwenyekiti wako Freeman Mbowe na vikao husika wakuvue madaraka unayoyashikilia kwenye chama Chama chako kwasababu na wewe ndiyo kabisa umetangaza adharani kuwa unautamani urais na kwa hatua hiyo hufanyikazi za kujenga chama chako?

Nimebaki kujiuliza Zitto ana ubongo wa Ndezi?.Kwani wataalamu wa viumbe hai wanatueleza kuwa ndege huyo aina ya Ndezi moja ya sifa yake kuu ni kusahau mambo.

Kuutaka urais kwa kufuata utaratibu husika ulioanishwa kwenye Katiba ya Nchi siyo kosa la jinai na ndiyo maana sisi waumini wa sheria tulivyomsikia Zitto kwa mara ya kwanza akimtaka rais Kikwete awatimue kazi mawaziri tisa ambao hakuwa taja majina eti kwasababu wanawaza urais, tulimpuuza na kumuona ni mbumbumbu wa sheria.

Kwasababu Zitto akutaja majina ya mawaziri wale ,ni wazi hakutoa ushahidi unaoonyesha moja kwa moja mawaziri hao hawafanyikazi kabisa wanauwaza huo urais.Na kwakuwa rais Rais Kikwete ni msikivu aliupuuzia ombi hilo kwasababu halina mashiko.

Wananchi kwa kauli hizo za Zitto zimenifanya nianze kujiuliza hivi kama hali ndiyo Je ahadi alizokuwa akizitoa jimboni kwake nyakati za kampeni atazitekeleza kweli?
Na ndiyo maana hivi sasa ameanza kupoteza mvuto na wananchi hawampapatikii kama walivyokuwa wakimpapatikia zamani kwani wananchi walijijengea akili mwao kuwa eti huyo ndiyo ni mkombozi wao na viongozi wengine ni mafisadi na wachumia tumbo.

Na kama hivi ndivyo,Zitto ana tofauti gani na wale baadhi ya mawaziri ambao amekuwa akizikosoa bajeti zao bungeni kuwa mawaziri hao wameingiza takwimu za uongo katika bajeti zao?

Maana kiongozi au mwananchi wa kada yoyote akishaanza kuwa na tabia ya leo anaibuka na kutaka wenzake waadhibiwe kwa kufanya jambo fulani halafu kesho kiongozi huyo anaibuka na kufanya jambo lile lile linalofanywa na wenzake halafu yeye anataka umma umuone yupo sahihi ila wenzie wamekosea, kiongozi wa aina hii ni hatari kwa mustakabali wa taifa na hafai kupewa madaraka makubwa ya kuiongoza nchi yetu kwani mwisho wa siku sisi wananchi tutakachojifunza kutoka kwa kiongozi wa aina hiyo ni ubinfasi na uchonganishi.

Aidha napenda kumshauri Zitto na vijana wenzake ambao wameonyesha tamaa ya kupata madaraka makubwa kwa kutumia hoja ya umri wa kuwa rais ubadilishwe kwenye Katiba ili vijana wenye umri wa chini ya miaka 40 waweze kugombea nafasi hizo, wapunguze papara kwani wahenga walisema Mbio za Sakafuni uishia ukingoni.

Kwani Watanzania wa leo siyo wale wa mwaka 1947, wanakufahamu vizuri wewe Zitto na hao vijana wenzako na hiyo kilicho nyuma ya ajenda hiyo ,msione wamewanyamazia kimya mkawaona ni majuha.

Wanafahamu fika hoja yenu hiyo ni kwa maslahi ya kikundi cha vijana wachache wenye madaraka ya kisiasa ambao hivi sasa wameanza kutuhumiwa huku mitaani kichini chini kuwa wana mali ambazo haziendani vipato vinavyotambulika na mamlaka husika na wenye tamaa ya kupata madaraka makubwa kuliko umri kwa haraka.

Kwa mtazamo wangu bado Tanzania hatujafikia hatua ya kuwa na rais kijana mwenye umri wa chini ya miaka 40 kwa kisingizio tu etu tunaenda na wakati. Sababu ya mimi kuwa na mtazamo huo licha mimi bado ni kijana mwenye umri wa miaka 33 ni kwamba hulka za sisi vijana wengi zinafahamika.

Lakini pia narudia kusisitiza kuwa kiti cha urais wa Tanzania, siyo kitu rahisi, rahisi kama watu wanavyodhani, ni kiti chenye heshima na hadhi ya kipekee ambacho kimebeba dhamana ya kuwaongoza watanzania wote wakubwa kwa wadogo, hivyo tusifanye majaribio katika kiti cha urais.
